National Insurance Company Limited.  There is no<br \/>\n\tneed to issue Rule on the other Respondents because admittedly the<br \/>\n\tamount due under the award has been deposited by Respondent no.1 ?<br \/>\n\tNational Insurance Company Limited.\n<\/p>\n<p>By<br \/>\n\tfiling this Application, the Applicants \/ original claimants have<br \/>\n\tprayed to pass necessary order regarding disbursement of the amount<br \/>\n\tawarded in their favour and deposited by Respondent No.1 ?<br \/>\n\tNational Insurance Co. Ltd. with the Tribunal concerned.\n<\/p>\n<p>The<br \/>\n\tApplicants have filed MACP No. 1123 of 2000 before the MACT,<br \/>\n\tPanchmahals at Godhra to recover compensation of Rs.10,20,000\/- on<br \/>\n\taccount of untimely demise of Himsingh Maganbhai Katara, who had<br \/>\n\tdied in a road accident.  The MACT, Godhra has passed award in<br \/>\n\tfavour of the Applicants to the extent of Rs.4,00,000\/- together<br \/>\n\twith interest and costs thereon against the insurer of both<br \/>\n\tInsurance Companies in the ratio of 80:20.  The Appellant &#8211;<br \/>\n\tInsurance Company is fasten with the liability of the 80% of the<br \/>\n\ttotal awarded amount.\n<\/p>\n<p>Aggrieved<br \/>\n\tthereby, the Appellant &#8211; Insurance Company filed First Appeal No.<br \/>\n\t3299 of 2005, which came to be admitted by a Division Bench of this<br \/>\n\tCourt vide order dated 24.10.2005 and in the Civil Application for<br \/>\n\tstay, Rule has been issued and impugned award has been stayed on<br \/>\n\tcondition to deposit the awarded amount which has come to the share<br \/>\n\tof the Insurance Company.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tC.A.Mehta, learned advocate of Respondent No.1 ?  Appellant &#8211;<br \/>\n\tInsurance Company Limited, upon instructions received from the<br \/>\n\tAppellant &#8211; Insurance Company Ltd., states that the Insurance<br \/>\n\tCompany has deposited Rs.4,02,323\/-  with the MACT, Godhra and the<br \/>\n\tamount of Rs.25,000\/-, which has been deposited at the time of<br \/>\n\tfiling of this Appeal, has already been transmitted to the Tribunal<br \/>\n\tconcerned.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by Mr. U.M.Shastri, learned<br \/>\n\tadvocate of the Applicants \/ original claimants and Mr. C.A.Mehta,<br \/>\n\tlearned advocate for respondent no.1 ?  National Insurance Company<br \/>\n\tLtd.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts and circumstances of the case, we direct that<br \/>\n\tfrom the amount deposited under award by Respondent No.1 ?<br \/>\n\tNational Insurance Company Ltd. pursuant to the order dated<br \/>\n\t24.10.2005, passed by a Division Bench of this Court in Civil<br \/>\n\tApplication No. 10899 of 2005, it will be open for the Applicant<br \/>\n\tNo.1, who is a guardian of Applicant Nos. 2 and 3 to withdraw 30% of<br \/>\n\tthe amount and rest of the amount payable to the Applicants under<br \/>\n\taward shall be invested in a fixed deposit in any of the<br \/>\n\tNationalized Banks in equal proportion in the name of three<br \/>\n\tApplicants initially for a period of three years yielding higher<br \/>\n\trate of interest, subject to further renewal from time to time, till<br \/>\n\tthe appeal is finally heard.  The Applicants are permitted to<br \/>\n\twithdraw interest accrued thereon periodically.\n<\/p>\n<p>Needless<br \/>\n\tto mention that the Applicants are not permitted to encash the said<br \/>\n\tFDR prematurely or create any charge upon the same without prior<br \/>\n\tpermission of the Court.\n<\/p>\n<p>Application<br \/>\n\tis disposed of accordingly.  Rule is made absolute.
