Justice K.T.SANKARAN\n\n Dated :07\/07\/2009\n\n O R D E R\n                            K.T.SANKARAN, J.\n               ------------------------------------------------------\n                          B.A. NO. 43 OF 2009\n               ------------------------------------------------------\n                     Dated this the 7th July, 2009\n\n\n                                 O R D E R\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of the<\/p>\n<p>Code of Criminal Procedure. The petitioners are the accused persons in<\/p>\n<p>Crime No.1349 of 2008 of Kadavanthara Police Station.<\/p>\n<p>       2. The offences alleged against the petitioners are under Sections<\/p>\n<p>405, 406, 409, 415, 417, 418, 420, 423 and 424 of the Indian Penal Code.<\/p>\n<p>       3. The gist of the prosecution case is that the first accused caused<\/p>\n<p>to publish advertisement in newspaper stating that his property was<\/p>\n<p>available for sale. The de facto complainant entered into an agreement<\/p>\n<p>for sale with the first accused and a sum of Rs.15 lakhs was paid as<\/p>\n<p>advance. On the date on which the agreement was entered into, the<\/p>\n<p>property was subject to attachment by civil court. Knowing fully well that<\/p>\n<p>there was attachment and that the first accused would not be entitled to<\/p>\n<p>transfer the property, the agreement was entered into. The petitioners<\/p>\n<p>moved for anticipatory bail before the learned Sessions Judge, which was<\/p>\n<p>dismissed by the Sessions Court, Ernakulam as per the order dated<\/p>\n<p>27.12.2008 in Crl.M.C.No.2324 of 2008.\n<\/p>\n<p>B.A. NO. 43 OF 2009<\/p>\n<p>                                          :: 2 ::\n<\/p>\n<\/p>\n<p>       4. I have gone through the case diary. I do not agree with the<\/p>\n<p>learned counsel for the petitioners that prima facie no offence is made out<\/p>\n<p>in the case.\n<\/p>\n<\/p>\n<p>       5.   However, the second petitioner\/second accused is not the<\/p>\n<p>owner of the property. There is no case that he has received any amount<\/p>\n<p>as consideration. He was a witness to the agreement. The allegation is<\/p>\n<p>that he also participated in the negotiations. The case of the second<\/p>\n<p>accused stands on a different footing.\n<\/p>\n<\/p>\n<p>       6. Taking into account the facts and circumstances of the case, I<\/p>\n<p>do not think that the first petitioner\/first accused is entitled to get an order<\/p>\n<p>for anticipatory bail.    However, I am of the view that the second<\/p>\n<p>petitioner\/second accused can be granted anticipatory bail.          There will<\/p>\n<p>be a direction that in the event of the arrest of the second petitioner, the<\/p>\n<p>officer in charge of the police station shall release him on bail for a period<\/p>\n<p>of one month on his executing bond for Rs.25,000\/- with two solvent<\/p>\n<p>sureties for the like amount to the satisfaction of the officer concerned,<\/p>\n<p>subject to the following conditions:\n<\/p>\n<p>B.A. NO. 43 OF 2009<\/p>\n<p>                                        :: 3 ::\n<\/p>\n<p>a)     The second petitioner shall report before the investigating officer<br \/>\n       between 9 A.M. and 11 A.M. on all Mondays, till the final report<br \/>\n       is filed or until further orders;\n<\/p>\n<p>b)     The second petitioner shall appear before the investigating officer<br \/>\n       for interrogation as and when required;\n<\/p>\n<p>c)     The second petitioner shall not try to influence the prosecution<br \/>\n       witnesses or tamper with the evidence;\n<\/p>\n<p>d)     The second petitioner shall not commit any offence or indulge in<br \/>\n       any prejudicial activity while on bail;\n<\/p>\n<p>e)     On the expiry of the period mentioned above or even before that<br \/>\n       period, the second petitioner shall surrender before the Magistrate<br \/>\n       concerned and seek regular bail;\n<\/p>\n<p>f)     In case of breach of any of the conditions mentioned above, the<br \/>\n       bail shall be liable to be cancelled.\n<\/p>\n<p>\n       The Bail Application is dismissed in so far as it relates to the first<\/p>\n<p>petitioner and allowed in the manner indicated above in so far as it relates<\/p>\n<p>to the second petitioner.\n<\/p>\n<\/p>\n<p>                                                      (K.T.SANKARAN)<br \/>\n                                                              Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Thomas George vs State Of Kerala on 7 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 43 of 2009() 1.
