SANKARAN, J.\n                      ------------------------\n                     B.A. No. 1368 of 2010\n                ------------------------------------\n              Dated this the 19th day of March, 2010\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for bail under Section 439 of the Code<\/p>\n<p>of Criminal Procedure. The petitioner is the accused in Crime No.<\/p>\n<p>18\/2010 of Kunnamangalam Police Station.<\/p>\n<p>      2. The offences alleged against the petitioner are under<\/p>\n<p>Section 376 of the Indian Penal Code and Sections 67 and 72 of<\/p>\n<p>the Information Technology Act.\n<\/p>\n<p>      3. The prosecution case is the following:\n<\/p>\n<p>      The petitioner is a bus conductor. The de facto complainant<\/p>\n<p>was studying in an Engineering College. The petitioner and the de<\/p>\n<p>facto complainant got acquaintance during travel.       In March,<\/p>\n<p>2006, about a year after they got acquaintance with each other,<\/p>\n<p>the petitioner took the girl to kalpetta under some pretext or<\/p>\n<p>other. On that day, they stayed in a lodge and she was subjected<\/p>\n<p>to forceful sexual intercourse. The petitioner promised to marry<\/p>\n<p>the girl.   Thereafter, for about four years, the relationship<\/p>\n<p>continued and the petitioner had sexual relationship with the girl<\/p>\n<p>at several places. The petitioner took the nude photographs of<\/p>\n<p><span class=\"hidden_text\">B.A. No. 1368 of 2010                2<\/span><\/p>\n<p>the girl in his mobile phone.       He published the same in the<\/p>\n<p>Internet.         A relative of the girl told her that her nude<\/p>\n<p>photographs were available in the Internet. On verification, it<\/p>\n<p>was found to be true. It was also revealed that the petitioner is a<\/p>\n<p>married man and that he had made all false promises.<\/p>\n<p>        4. The matter was reported by the girl to the police on<\/p>\n<p>23.01.2010 and crime was registered.           The petitioner was<\/p>\n<p>arrested on 29.01.2010 and he was remanded to judicial<\/p>\n<p>custody.\n<\/p>\n<p>        5. The petitioner moved for bail before the court of the<\/p>\n<p>Sessions Judge, Kozhikode. The Bail Application was dismissed<\/p>\n<p>by the order dated 23.02.2010. The investigation has progressed<\/p>\n<p>thereafter.\n<\/p>\n<p>        6. The learned counsel for the petitioner submitted that the<\/p>\n<p>petitioner is prepared to comply with any condition that may be<\/p>\n<p>imposed by the Court for granting bail.\n<\/p>\n<p>        7. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p><span class=\"hidden_text\">B.A. No. 1368 of 2010                    3<\/span><\/p>\n<p>petitioner on stringent conditions.\n<\/p>\n<p>         8. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.50,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class, Kunnamangalam subject to the following conditions:-<\/p>\n<blockquote><p>                 A)     The petitioner shall not leave Thrissur<br \/>\n                      District without the permission of the<br \/>\n                      Judicial Magistrate of the First Class,<br \/>\n                      Kunnamangalm, till the final report is filed<br \/>\n                      or until further orders.\n<\/p><\/blockquote>\n<blockquote><p>                 B) The petitioner shall report before the District<br \/>\n                      Superintendent of Police, Thrissur between<br \/>\n                      9 A.M. and 11 A.M. on every Monday and<br \/>\n                      Thursday, till the final report is filed or<br \/>\n                      until further orders.\n<\/p><\/blockquote>\n<blockquote><p>                 C)   The petitioner shall     appear before the<br \/>\n                      Investigating Officer for interrogation as<br \/>\n                      and when required.\n<\/p><\/blockquote>\n<blockquote><p>                 D)  The petitioner shall surrender his passport<br \/>\n                      before the Court of the Judicial Magistrate<br \/>\n                      of the First Class, Kunnamangalam within<br \/>\n                      one week from the date of release on bail.<br \/>\n                      If the petitioner does not hold an Indian<br \/>\n                      Passport, an affidavit sworn to by him to<br \/>\n                      that effect shall be filed before the learned<br \/>\n                      Magistrate within one week.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A. No. 1368 of 2010                  4<\/span><\/p>\n<blockquote><p>                 E) The petitioner shall not try to influence the<br \/>\n                      prosecution witnesses or tamper with the<br \/>\n                      evidence.\n<\/p><\/blockquote>\n<blockquote><p>                 F) The petitioner shall not commit any offence<br \/>\n                      or indulge in any prejudicial activity while<br \/>\n                      on bail.\n<\/p><\/blockquote>\n<blockquote><p>                 G)   In case of breach of any of the conditions<br \/>\n                      mentioned above, the bail shall be liable to<br \/>\n                      be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>         The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>         The Registry will forward a copy of this order to the District<\/p>\n<p>Superintendent of Police, Thrissur.\n<\/p>\n<\/p>\n<p>                                     K.T.
