Justice P.R.RAMAN\n\n Dated :06\/02\/2007\n\n O R D E R\n                                 P.R.RAMAN, J.\n\n                         ```````````````````````````\n\n                       W.P.(C) NO. 26706 OF 2005\n\n                         ```````````````````````````\n\n             Dated this the 6th day of February, 2007\n\n\n                                J U D G M E N T\n<\/pre>\n<p>       Petitioners&#8217; lands were acquired for widening of a road.  It is<\/p>\n<p>the contention of the petitioners that in the meeting held by the<\/p>\n<p>District   Collector   and   the   other   officers   from   K.S.T.P,   it   was<\/p>\n<p>assured to the petitioners that a retaining wall will be constructed<\/p>\n<p>for   giving   lateral   support   for   the   petitioners   remaining   land   and<\/p>\n<p>residential building, provided the petitioners surrender their land<\/p>\n<p>for   road   for   the   value   fixed   by   the   authorities.     On   that   basis,<\/p>\n<p>consent was given and land was acquired and the petitioners did<\/p>\n<p>not seek for any enhancement because of the assurance so made.<\/p>\n<p>But after widening the road, the respondent did not construct the<\/p>\n<p>retaining wall as assured.\n<\/p>\n<\/p>\n<p>       2.     The first petitioner has preferred Ext.P3 representation<\/p>\n<p>before the District Collector seeking redressal of his grievance in<\/p>\n<p>the matter.\n<\/p>\n<\/p>\n<p>       3.     Heard the learned Government pleader.<\/p>\n<p>       4.     In   the   facts   and   circumstances,   the   District   Collector,<\/p>\n<p>Ernakulam shall consider Ext.P3 submitted by the first petitioner<\/p>\n<p>WPC  26706\/2005<\/p>\n<p><span class=\"hidden_text\">                                        : 2 :<\/span><\/p>\n<p>and   dispose   of   the   same   in   accordance   with   law.
