Act.\n<\/p>\n<p>The<br \/>\n\tcase of the prosecution is that on or around 22nd<br \/>\n\tFebruary 1994, on the roof of residence of accused, one bag was<br \/>\n\tfound having contraband article Ganja in the bag. It is also the<br \/>\n\tcase of the prosecution that police has also found plants of<br \/>\n\tcontraband article Ganja, which were recovered by the police in<br \/>\n\tpresence of panchas. It was found that weight of the dry Ganja was<br \/>\n\t5,200 gms and weight of the plants was 4,200 gms. Therefore, a<br \/>\n\tcomplaint to the said effect was was filed.\n<\/p>\n<p>Thereafter<br \/>\n\tpanchnama of the scene of offence was drawn and statement of<br \/>\n\twitnesses were recorded. Statement of Talati-cum-Mantri was recorded<br \/>\n\twith regard to the land and survey number of the house of the<br \/>\n\trespondent-accused. Thereafter, muddamal was sent for analysis to<br \/>\n\tForensic Science Laboratory and after the certificate received from<br \/>\n\tFSL, as sufficient evidence was found against the<br \/>\n\trespondent-accused, the respondent-accused was charge-sheeted before<br \/>\n\tthe Court of learned Judicial Magistrate First Class, Deesa.\n<\/p>\n<p>\tThereafter,<br \/>\n\tas the case was exclusively triable by the Court of Sessions, the<br \/>\n\tcase was transferred to the Sessions Court, Palanpur. Thereafter,<br \/>\n\tcharge was framed below Exhibit 6 against the respondent-accused and<br \/>\n\tas the respondent-accused denied the case and has not pleaded<br \/>\n\tguilty, trial was commenced. To prove the case of the prosecution,<br \/>\n\tprosecution has produced oral as well as documentary evidence in<br \/>\n\tsupport of their case. After filing closing pursis by the<br \/>\n\tprosecution, further statement of the respondent-accused under<br \/>\n\tSection 313 of the Code of Criminal Procedure, 1973. The<br \/>\n\tappellant-accused has not produced any oral evidence in support of<br \/>\n\this case. Neither the appellant has examined any witnesses nor he<br \/>\n\thas given any deposition on oath to prove his case.\n<\/p>\n<p>After<br \/>\n\thearing both the sides, the learned Sessions Judge, Banaskantha at<br \/>\n\tPalanpur, by his judgment and order dated 15th<br \/>\n\tFebruary 1999 passed in Sessions Case No.138 of 1994, was pleased to<br \/>\n\tconvict the respondent-accused for the offence punishable under<br \/>\n\tSection 8(B) and 20(A) of the N.D.P.S. Act and ordered to undergo<br \/>\n\trigorous imprisonment for a period of one month and also imposed<br \/>\n\tfine of Rs.200\/-, and in default of payment of fine, ordered to<br \/>\n\tundergo rigorous imprisonment for a further period of seven days.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said judgment and order dated<br \/>\n\t15th<br \/>\n\tFebruary 1999 passed by the learned Sessions Judge, Banaskantha at<br \/>\n\tPalanpur, in Sessions Case No.138 of 1994, the appellant-State of<br \/>\n\tGujarat has preferred the above-mentioned Criminal Appeal for<br \/>\n\tenhancement of sentence before this Hon&#8217;ble Court.\n<\/p>\n<p>I<br \/>\n\thave heard Mr.R.C. Kodekar, learned Additional Public Prosecutor,<br \/>\n\tappearing on behalf of the appellant-State. I have also gone through<br \/>\n\tthe papers and the judgment and order passed by the trial Court.\n<\/p>\n<p>Mr.R.C.\n<\/p>\n<p>\tKodekar, learned Additional Public Prosecutor, has contended that<br \/>\n\tthe judgment and order of conviction passed by the learned trial<br \/>\n\tJudge is not legal and proper. He has contended that 5,200 gms. of<br \/>\n\tGanja was found from the possession of the respondent-accused.<br \/>\n\tLooking to the quantity of Ganja recovered from the possession of<br \/>\n\tthe respondent, it is not small quantity. He has also contended that<br \/>\n\tlooking to the quantity of contraband article Ganja, the learned<br \/>\n\ttrial Judge has awarded minimum sentence to the respondent-accused.<br \/>\n\tMr.Kodekar has also contended that the learned trial Judge has erred<br \/>\n\tin not awarding minimum sentence prescribed under the N.D.P.S. Act<br \/>\n\tto the appellant-accused. He has also contended that the contraband<br \/>\n\tarticle Ganja is dangerous to the public health. He, therefore,<br \/>\n\tcontended that looking to the overall facts and circumstances of the<br \/>\n\tcase, sentence awarded to the respondent-accused is required to be<br \/>\n\tenhanced.\n<\/p>\n<p>I<br \/>\n\thave<br \/>\n\tgone through the judgment and order passed by the trial Court. I<br \/>\n\thave also perused the oral as well as documentary evidence led<br \/>\n\tbefore the trial Court and also considered the submissions made by<br \/>\n\tlearned counsel. I have also gone through the provisions of law.\n<\/p>\n<p>It<br \/>\n\tappears from the papers that the judgment and order of conviction<br \/>\n\twas passed on 15th<br \/>\n\tFebruary 1999 and today, in<br \/>\n\tthe year 2011, present appeal came before this Court for enhancement<br \/>\n\tof the sentence imposed upon the respondent-accused. From the<br \/>\n\tperusal of the papers it appears that after appreciating all the<br \/>\n\tevidence on record and facts of the case as well as looking to the<br \/>\n\tcircumstantial evidence on record, the learned trial Judge has<br \/>\n\tpassed absolutely just and proper order. I have not found anything<br \/>\n\tprima-facie to say that the learned trial Judge has awarded minimum<br \/>\n\tsentence. It also appears from the papers that the<br \/>\n\trespondent-accused has seven children and he is the only bread<br \/>\n\tearner of the family. He is a very poor person and therefore,<br \/>\n\tlooking to the overall facts and circumstances of the case, the<br \/>\n\tlearned trial Judge has passed just order.\n<\/p>\n<p>Hence,<br \/>\n\tin view of above, I am in complete agreement with the findings,<br \/>\n\tultimate conclusion and the resultant order of conviction recorded<br \/>\n\tby the trial Court and find no reason to interfere with the same.<br \/>\n\tHence, the present appeal is required to be dismissed and is hereby<br \/>\n\tdismissed. The judgment and order of conviction and sentence dated<br \/>\n\t15th<br \/>\n\tFebruary 1999 passed by the learned Sessions Judge, Banaskantha at<br \/>\n\tPalanpur, in Sessions Case No.138 of 1994, is hereby confirmed.<br \/>\n\tBail bond, if any, shall stand discharged.
