Kishanganj (Bihar)\n                                             -----------\n<\/pre>\n<p>3.   26.08.2011              Learned counsel for the State takes a<\/p>\n<p>                   preliminary objection to the remedy of appeal<\/p>\n<p>                   available to the petitioner under Rule 25 of the Bihar<\/p>\n<p>                   C.C.A. Rules, 2005 against the order of punishment<\/p>\n<p>                   dated 14.9.2007 in pursuance of a departmental<\/p>\n<p>                   proceeding commenced on 23.1.2006.\n<\/p>\n<p>                             Learned counsel then prays for leave to<\/p>\n<p>                   withdraw the application to avail the remedies of<\/p>\n<p>                   appeal. He prays that the Court may condone the<\/p>\n<p>                   limitation for any delay in preferring the appeal.<\/p>\n<p>                             Rule 25 vests power in the appellate<\/p>\n<p>                   authority to consider any application for condoning<\/p>\n<p>                   the delay in preferring the appeal. This Court cannot<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>           usurp the power of the appellate authority.    If the<\/p>\n<p>           petitioner files an appeal along with an application<\/p>\n<p>           for condonation of the same, the latter has to be<\/p>\n<p>           considered in accordance with law under Rule 25.<\/p>\n<p>                     The application is dismissed as withdrawn<\/p>\n<p>           with the liberty as aforesaid.\n<\/p>\n<\/p>\n<pre>P.
