Tahilramani, J. <\/p>\n<p> 1. Heard the learned Counsel for the petitioner<br \/>\nand the learned Counsel for the respective respondents.\n<\/p>\n<p> 2. The  present  writ  petition   is   directed<br \/>\nagainst  the  order  dated  01.05.2001  terminating  the<br \/>\nservices of the petitioner with effect from  01.06.2001.<br \/>\nThe said order was issued by the present respondent no. 3<br \/>\ni.e.   Shri Chhatrapati Shivaji Shikshan Prasarak Mandal<br \/>\n(for short the Mandal).   The  present  writ  petition<br \/>\nalso   challenges  the  advertisement  dated  10.06.2001<br \/>\ninviting   applications   for   the   post   of   Hostel<br \/>\nSuperintendent.\n<\/p>\n<p> 3. The  Government of Maharashtra took a policy<br \/>\ndecision to establish Girls Hostels in every taluka  in<br \/>\nthe  State  in  the  memory  of the Ex-Prime Minister of<br \/>\nIndia Smt. Indira Gandhi.  The said Priyadarshini  Girls<br \/>\nHostels  were  to  run  on  the lines of the Hostels for<br \/>\ndepressed classes run by the Social Welfare  Department.<br \/>\nThe  Government  of  Maharashtra  framed  the  rules for<br \/>\nmanagement of such Priyadarshini Girls  Hostels,  which<br \/>\nwere  applicable  to the voluntary organisations running<br \/>\nsuch Hostels.  The Respondent No. 3 &#8211; Mandal is one  such<br \/>\norganisation  running  a  Priyadarshini Girls Hostel at<br \/>\nKannad.\n<\/p>\n<p> 4. The Respondent No. 3 &#8211; Mandal  had  published<br \/>\nan  advertisement  inviting applications for the post of<br \/>\nHostel Superintendent in the Priyadarshini Girls  Hostel<br \/>\nat Kannad.   Several candidates including the petitioner<br \/>\nhad applied for the said post.  The petitioner  came  to<br \/>\nbe  selected and appointed as Hostel Superintendent with<br \/>\neffect from 16.11.1998 by the Respondent No. 3.  However,<br \/>\nas the premises for the Girls Hostel  were  not  handed<br \/>\nover  by  the  Government  to  the  Respondent No. 3, the<br \/>\nHostel  could  not  function  for  about   4\/5   months.<br \/>\nThereafter  the  premises  came to be handed over by the<br \/>\nGovernment to the Respondent No. 3 Mandal.  The President<br \/>\nof the Respondent No. 3 &#8211; Mandal informed the  petitioner<br \/>\nby  letter  dated  29.11.2000  to  start  functioning as<br \/>\nSuperintendent of the  Girls  Hostel  with  effect  from<br \/>\n01.12.2000.   However,  it  was  made  clear in the said<br \/>\nletter that her appointment shall be regularised, as per<br \/>\nthe rules, immediately after grant of  approval  by  the<br \/>\nRespondent  No. 2  &#8211;  Joint  Director (Higher Education),<br \/>\nAurangabad.  The Respondent No. 3  Mandal  had  forwarded<br \/>\nthe   proposal  for  the  purpose  of  approval  to  the<br \/>\nappointment of the petitioner as  Hostel  Superintendent<br \/>\nto the Joint Director (Higher Education), Aurangabad, on<br \/>\n01.12.2000.   The  approval to her appointment as Hostel<br \/>\nSuperintendent was awaited.  Thereafter, the  Respondent<br \/>\nNo. 3  &#8211; Mandal, by letter dated 01.05.2001, informed the<br \/>\npetitioner  that  though  the  proposal  for  grant   of<br \/>\napproval  to the appointment of the petitioner as Hostel<br \/>\nSuperintendent was sent to the  Joint  Director  (Higher<br \/>\nEducation),  Aurangabad,  no  approval, as yet received.<br \/>\nIt is  further  stated  in  the  said  letter  that  the<br \/>\npetitioner did not possess the requisite qualifications,<br \/>\nhence, the petitioner was directed not to work as Hostel<br \/>\nSuperintendent  from  the  new  academic year commencing<br \/>\nfrom June 2001.\n<\/p>\n<p> 5. The petitioner sent two  representations  to<br \/>\nthe  Joint  Director  dated  01.06.2001  and  18.06.2001<br \/>\nrequesting him to grant approval to the  appointment  of<br \/>\nthe petitioner   as   Hostel  Superintendent.    In  the<br \/>\nmeanwhile, the Respondent No. 3 &#8211; Mandal  on  10.06.2001,<br \/>\nhad published an advertisement inviting applications for<br \/>\nthe post   of   Hostel  Superintendent.    In  the  said<br \/>\nadvertisement, the requisite  qualification  for  Hostel<br \/>\nSuperintendent  was  mentioned  as Graduation with B.Ed.<br \/>\nAs stated earlier, the  petitioner  has  challenged  the<br \/>\ntermination  of  her services on the ground that she did<br \/>\nnot possess the requisite qualification as well  as  the<br \/>\nadvertisement  issued by the Respondent No. 3 for filling<br \/>\nin the post of Hostel Superintendent.  It  is  contended<br \/>\non  behalf  of  the  petitioner that the Respondent No. 3<br \/>\nMandal has falsely prescribed the qualification of B.Ed.<br \/>\nfor the post of Hostel Superintendent.  It is stated  on<br \/>\nbehalf    of   the   petitioner   that   the   requisite<br \/>\nqualification for the post of Hostel  Superintendent  as<br \/>\nper  Rule  23(a)  is  Graduation  or  SSC  passed  or an<br \/>\nexperienced woman who shall permanently  reside  in  the<br \/>\nsaid Hostel.    It is further stated that the petitioner<br \/>\nhad the requisite qualifications for being appointed  as<br \/>\na  Hostel  Superintendent  and hence the Respondent No. 3<br \/>\nhas  wrongly  removed  her  from  the  post  of   Hostel<br \/>\nSuperintendent.   It  was  stated  that  the  petitioner<br \/>\npossessed  the  requisite  qualifications,   hence   her<br \/>\nremoval  on  the  ground  that  she  did not possess the<br \/>\nrequisite qualification  is  without  any  substance  or<br \/>\nfoundation.   There  is  no  rule  or  regulation  which<br \/>\nrequires that the  candidate  for  the  post  of  Hostel<br \/>\nSuperintendent must possess  B.Ed.   qualification.  The<br \/>\nlearned  Counsel  for  the  petitioner  states  that  no<br \/>\nmisconduct was alleged on the part of the petitioner nor<br \/>\nany   show   cause   notice  was  given  to  her  before<br \/>\nterminating her services and hence, there was no ground,<br \/>\nmuch less a  justifiable  reason,  for  terminating  her<br \/>\nservices.\n<\/p>\n<p> 6. It  is further stated that the Priyadarshini<br \/>\nGirls Hostel was receiving 100% salary grants  as  well<br \/>\nas  building  grants  and  was  under the control of the<br \/>\nGovernment and the Rules and Regulations for appointment<br \/>\nof Hostel Superintendent, Payment of Grants, etc.    are<br \/>\nframed by the Government.  It is contended that thus the<br \/>\nGovernment exercises deep and pervasive control over the<br \/>\nHostel  despite  the  fact  that  the Hostel is run by a<br \/>\nvoluntary organisation.  This voluntary organisation was<br \/>\nselected by the Government of  Maharashtra  to  run  the<br \/>\nPriyadarshini Girls  Hostel.  In view of the above, the<br \/>\nRespondent No. 3 is amenable to the writ jurisdiction  of<br \/>\nthis Court.\n<\/p>\n<p> 7. A  return  has  been  filed on behalf of the<br \/>\nRespondent No. 2 &#8211;  Joint  Director  (Higher  Education),<br \/>\nAurangabad.   In  the  said  return  it is categorically<br \/>\nstated that the Government Resolution  dated  30.06.1999<br \/>\nis  applicable  to  the  post claimed by the petitioner.<br \/>\nRule 26 (A) of the said Resolution prescribes  that  the<br \/>\nnecessary qualification required for holding the post of<br \/>\nHostel  Superintendent is Graduation or SSC passed or an<br \/>\nexperienced woman who shall permanently  reside  in  the<br \/>\nsaid Hostel.\n<\/p>\n<p> 8. Looking  to  this  admitted  position, it is<br \/>\nclear  that   the   petitioner   holds   the   requisite<br \/>\nqualification  for  the post of Hostel Superintendent in<br \/>\nPriyadarshini Girls Hostel run by the  Respondent  No. 3<br \/>\nMandal.  The  petitioner  is  M.A.    and, therefore, it<br \/>\ncannot be said that she is not possessing the  requisite<br \/>\nqualification  for being appointed to the post of Hostel<br \/>\nSuperintendent in Priyadarshini Girls Hostel.  In  this<br \/>\nview  of  the  matter,  removal  of  the petitioner from<br \/>\nservice  on  the  ground  that  she  did  not  hold  the<br \/>\nrequisite   qualification   for   the   post  of  Hostel<br \/>\nSuperintendent is erroneous and  illegal.    Hence,  the<br \/>\norder  of  termination  dated  01.05.2001 deserves to be<br \/>\nquashed and set aside so also the  advertisement  issued<br \/>\nby the Respondent No. 3 &#8211; Mandal dated 10.06.2001 for the<br \/>\npost of Hostel Superintendent stating that the requisite<br \/>\nqualification is   B.Ed.      is   also   erroneous  and<br \/>\nconsequently, the said advertisement will also  have  to<br \/>\nbe quashed.\n<\/p>\n<p> 9. It  may  be  stated  that  at  the  time  of<br \/>\nadmission, this Court  by  order  dated  07.11.2001  had<br \/>\ngranted  ad interim relief in terms of prayer clause (C)<br \/>\nwhich reads as under:\n<\/p>\n<p>  (C)  To grant  interim  stay  to  the  operation,<br \/>\nexecution    and   implementation   of   the<br \/>\norder\/letter dated 01.05.2001 directing  the<br \/>\npetitioner    not    to   work   as   Hostel<br \/>\nSuperintendent issued by  the  President  of<br \/>\nthe  respondent  no. 3  &#8211;  Mandal  (Exh.&#8221;K&#8221;),<br \/>\npending hearing and final disposal  of  this<br \/>\npetition.\n<\/p>\n<p> Thereafter   on  8th  July  2002,  Rule  was<br \/>\ngranted and Rule on stay was made returnable after three<br \/>\nmonths and in  the  mean  time,  ad  interim  order  was<br \/>\ncontinued.   In  view of these orders, the petitioner is<br \/>\ncontinued on the post of Hostel Superintendent.\n<\/p>\n<p> 10. In the result, in view of the fact that  the<br \/>\npetitioner  possessed  the requisite qualifications, the<br \/>\norder of her termination  and  the  advertisement  dated<br \/>\n10.06.2001 are  set  aside.    Thus,  we  make  the Rule<br \/>\nabsolute in terms of Prayer Clauses (A) and  (B),  which<br \/>\nread as under:\n<\/p>\n<p> (A)  To  quash  the  impugned  letter\/order dated<br \/>\n01.05.2001 directing the petitioner  not  to<br \/>\nwork    as    Hostel    Superintendent    of<br \/>\nPriyadarshini Girls Hostel  issued  by  the<br \/>\nPresident  of  the  respondent no. 3 &#8211; Mandal<br \/>\n(Exh-&#8220;K&#8221;) by issuing a writ of certiorari or<br \/>\nany  other  appropriate   writ,   order   or<br \/>\ndirection, as the case may be.\n<\/p>\n<p> (B)  To  quash  the  impugned advertisement dated<br \/>\n<span class=\"hidden_text\">10.06.2001 published by the Respondent  No. 3<\/span><br \/>\n(Exh-&#8220;N&#8221;)    in   daily   &#8220;Sakal&#8221;   inviting<br \/>\napplications  for   the   post   of   Hostel<br \/>\nSuperintendent   in   Priyadarshini   Girls<br \/>\nHostel  published  by  the  respondent  no. 3<br \/>\nMandal  by  issuing  a writ of certiorari or<br \/>\nany  other  appropriate   writ,   order   or<br \/>\ndirections, as the case may be.\n<\/p>\n<p> 11.
