This is a petition filed by the Managing partner of<\/p>\n<p>M\/s.Pentagon Builders praying to issue a writ of mandamus to<\/p>\n<p>respondents 1 to 3 to afford necessary protection for the safe<\/p>\n<p>transit, ingress and egress of materials, men and machinery to<\/p>\n<p>the work site referred to in Exts.P1 and P2. It is the case of the<\/p>\n<p>petitioner that he has obtained the necessary building permit<\/p>\n<p>from the Corporation of Kozhikode as evidenced by Exts.P1 and<\/p>\n<p>P2. They have also put up a safety wall surrounding the site<\/p>\n<p>before the commencement of the building as required in Ext.P1.<\/p>\n<p>However, when they started the construction work and<\/p>\n<p>arrangements were made thereto, the 4th respondent samithy<\/p>\n<p>caused obstruction by gathering in large numbers and stopping<\/p>\n<p>the vehicles. Despite complaint made to the police, no action<\/p>\n<p>was taken. Hence this writ petition for police protection.<\/p>\n<p><span class=\"hidden_text\">WPC 13857\/09                        2<\/span><\/p>\n<p>      2. Respondents 4 and 5 appeared and filed counter<\/p>\n<p>affidavits. It is their case that the society is registered under the<\/p>\n<p>Societies Registration Act and the 4th respondent is the<\/p>\n<p>president of the said society. The very purpose of the formation<\/p>\n<p>of the society is to protect the environment. According to them,<\/p>\n<p>the permit itself was granted for construction in violation of the<\/p>\n<p>provision relating to protection coastal areas and according to<\/p>\n<p>them, the proposed building is only 100 metres away from the<\/p>\n<p>beach. Further, on account of JCB operations at the site, 18 of<\/p>\n<p>the nearby residences were damaged and on complaint being<\/p>\n<p>made, the Corporation caused to conduct an inspection. There<\/p>\n<p>is a protest against the construction activities. According to<\/p>\n<p>them, the multi-storeyed construction like the one carried out by<\/p>\n<p>the petitioner between the residence of the local fishermen and<\/p>\n<p>the beach will have the impact of fishermen loosing easy access<\/p>\n<p>for fishing operation. This is the sum and substance of the<\/p>\n<p>grievance raised by the petitioner. The learned Government<\/p>\n<p>Pleader on behalf of the State would submit that the complaint<\/p>\n<p>was received only by registered post.\n<\/p>\n<p><span class=\"hidden_text\">WPC 13857\/09                      3<\/span><\/p>\n<p>      3. The fact remains that the petitioner with a view to<\/p>\n<p>construct the building has purchased a land obtained necessary<\/p>\n<p>permits. It is not shown that any other permit is required to be<\/p>\n<p>obtained by the petitioner. According to the 4th respondent, the<\/p>\n<p>alleged construction is within a distance of 100 metres and that<\/p>\n<p>it violates the environmental laws. No specific provision is<\/p>\n<p>referred to nor brought to our notice. At any rate, if the alleged<\/p>\n<p>construction is in violation of any provisions of law, it is certainly<\/p>\n<p>open to the 4th respondent to approach the appropriate authority<\/p>\n<p>who granted permission, pointing out the same. So long as no<\/p>\n<p>such complaint is made and so far as the petitioner is carrying<\/p>\n<p>out the construction activities after obtaining the necessary<\/p>\n<p>permits, no obstruction should be caused to the construction<\/p>\n<p>activities. If the 4th respondent has got any sentimental or other<\/p>\n<p>objections, this court cannot prevent them from raising such<\/p>\n<p>protest in a peaceful manner. So long as any agitation is done in<\/p>\n<p>a peaceful manner allowed by law, the police will not interfere.<\/p>\n<p>However, if they transgress their limits to one of taking law into<\/p>\n<p>their own hands, causing physical obstruction, certainly the<\/p>\n<p><span class=\"hidden_text\">WPC 13857\/09                      4<\/span><\/p>\n<p>petitioner is entitled for necessary protection in this regard and<\/p>\n<p>the police shall afford such protection.\n<\/p>\n<p>      The writ petition is disposed of as above.<\/p>\n<pre>\n\n\n\n\n                                       P.R.RAMAN, JUDGE\n\n\n\n                                       P.BHAVADASAN, JUDGE\n\nsta\n\nWPC 13857\/09    5\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Dr.K.M.Ashik vs The S.I.
