YUNUS\n\nDATE OF JUDGMENT17\/09\/1993\n\nBENCH:\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>&amp;<br \/>\n     ORDER\n<\/p>\n<p>1.   We\t have  heard  the counsel  on  either  side.   Leave<br \/>\ngranted.\n<\/p>\n<p>2.   This  appeal arises against the order of  the  tribunal<br \/>\nmade  in  O.A. No. 1005 of 1989 dated March 22,\t 1993.\t The<br \/>\nrespondent is an ex-serviceman.\t He applied for\t recruitment<br \/>\nto   Orissa  Administrative  Service,  Class  11.    Pending<br \/>\nproceedings  a direction was given to keep one\tpost  vacant<br \/>\nfor  consideration  of\tthe appellant in the  event  of\t his<br \/>\nsucceeding  in\tthe  original  application.   The   tribunal<br \/>\nallowed\t the  petition and directed to appoint him  in\tthat<br \/>\npost.\tThe  State is aggrieved against this  order.   Thus,<br \/>\nthis appeal by special leave.\n<\/p>\n<p>3.The only question that arises for consideration in this<br \/>\nappeal\tis whether the respondent could be treated on a\t par<br \/>\nwith  members of the Scheduled Castes and  Scheduled  Tribes<br \/>\nfor  lowering  the  standard for  selection  by\t the  Public<br \/>\nService Commission.  The tribunal following the judgment  of<br \/>\nthe Full Bench of Punjab and Haryana High Court in the\tcase<br \/>\nof  <a href=\"\/doc\/616713\/\">Jagdish  Rai  v. State of  Haryana&#8217;<\/a>\t directed  that\t the<br \/>\nrespondent is entitled to the same benefits.  We are  unable<br \/>\nto  agree with the tribunal and the ratio in the Full  Bench<br \/>\njudgment.   The members of the SCs and STs have\t been  given<br \/>\nbenefit\t by operation of Article 16(4) of the  Constitution.<br \/>\nAny   concession  or  relaxation  in  their  favour  is\t  in<br \/>\ncompliance of the constitutional mandate to provide adequate<br \/>\nrepresentation\tof  them in any service or posts  under\t the<br \/>\nState.\tAny other category other than SCs and STs cannot  be<br \/>\nput  on a par with them in the matters of relaxation of\t the<br \/>\nconditions  for\t recruitment  or other\tconditions.   It  is<br \/>\nstated\tby Mr Mehta, learned counsel for the State that\t the<br \/>\nCommission  has\t put a minimum of 780  marks  as  qualifying<br \/>\nmarks for the general candidates.  The respondent admittedly<br \/>\nbelongs\t to the general category.  Though three\t posts\thave<br \/>\nbeen reserved for ex-servicemen, if a candidate who  belongs<br \/>\nto  ex-servicemen gets eligibility by securing\t780  minimum<br \/>\nmarks,\tirrespective  of the fact whether he\/they  comes  by<br \/>\ngeneral\t selection or not, by virtue of reservation made  to<br \/>\nthe ex-servicemen, he\/they<br \/>\n+  Arising out of SLP (C) No. 10343 of 1993<br \/>\n1 AIR 1977 P&amp;H 56: 79 Punj LR 1 : 1977 Lab IC 353<br \/>\n<span class=\"hidden_text\">56<\/span><br \/>\nbecome eligible for consideration.  This relaxation has been<br \/>\nmade in contradistinction with other general candidates\t but<br \/>\nfor which the respondent would be ineligible.  The  fixation<br \/>\nof  the\t general standard marks prescribed for\tthe  general<br \/>\ncandidates would undoubtedly be a handicap to the ex-service<br \/>\npersonnel  who\tare made to compete  with  youngsters  after<br \/>\nseveral\t years of service put in the defence  service.\t The<br \/>\nState  Government  and\tthe Public  Service  Commission\t are<br \/>\ndirected  to  consider\tthe desirability  to  fix  a  lesser<br \/>\nstandard  than\tthat  of  the  general\tcandidates  as\t ex-<br \/>\nservicemen have served the nation in its defence and in\t the<br \/>\nprocess\t they  may  not\t come on  a  par  with\tthe  general<br \/>\ncandidates.   Therefore,  some relaxation  in  their  behalf<br \/>\nwould be necessary to meet the exigencies of coping up\twith<br \/>\nthe reservation given to them.\tOtherwise, reservation would<br \/>\nbe illusory.  The State Government in consultation with\t the<br \/>\nPublic\tService Commission would decide this issue within  a<br \/>\nperiod of three months from the date of the receipt of\tthis<br \/>\norder  and  thereafter consider the case of  the  respondent<br \/>\naccordingly.\n<\/p>\n<p>4.   The appeal is allowed with no order as to costs.\n<\/p>\n<p>     ORDER\n<\/p>\n<p>1.   Leave granted.  Heard on merits.\n<\/p>\n<p>2.   The appellant was appointed as a Constable in the\tU.P.<br \/>\nPolice\tForce  on probation in a clear vacancy\tin  December<br \/>\n1986.  He was then sent for training at the Police  Training<br \/>\nSchool,\t Moradabad  in\tJanuary 1987  and  had\tsuccessfully<br \/>\ncompleted  the training course.\t In December 1990 while\t the<br \/>\nappellant was<br \/>\n+  Arising out of SLP (Civil) No. 14711 of 1991<br \/>\n<span class=\"hidden_text\">57<\/span><br \/>\nposted\tas a Constable in Police Station Nangla in  District<br \/>\nBijnor,\t a report was made by the Station House\t Officer  on<br \/>\nDecember   17,\t1990  accusing\tthe  appellant\tof   certain<br \/>\nmisconduct.   The very next day, on December 18,  1990,\t the<br \/>\nappellant  was\ttransferred to the Police  Lines.   However,<br \/>\nwithout\t holding  any  inquiry, on December  19,  1990,\t the<br \/>\nappellant&#8217;s services were terminated (Annexure B) by  giving<br \/>\nhim  one  month&#8217;s salary in lieu of notice.   The  appellant<br \/>\nchallenged the termination of his services by filing a\twrit<br \/>\npetition  in the Allahabad High Court.\tThat  writ  petition<br \/>\nhas  been dismissed by the impugned judgment dated July\t 20,<br \/>\n1991.  Hence this appeal by special leave.\n<\/p>\n<p>3.The High Court has taken the view that the services  of<br \/>\nthe appellant being merely temporary, there was no infirmity<br \/>\nin the termination of his services in this manner.   Learned<br \/>\ncounsel\t for the appellant submitted that the appellant\t was<br \/>\nnot appointed merely temporarily but on probation in a clear<br \/>\nvacancy and, therefore, the procedure for termination of his<br \/>\nservices would be governed by Regulation 541 of U.P.  Police<br \/>\nRegulations;  and  that\t the termination  having  been\tmade<br \/>\nwithout\t complying with the requirements of Regulation\t541,<br \/>\nit  was\t invalid.  In reply, learned counsel for  the  State<br \/>\nmerely\tcontended that the appointment of the appellant\t was<br \/>\nnot  on\t probation  in a clear\tvacancy\t but  was  temporary<br \/>\nappointment which was not governed by Regulation 541 of\t the<br \/>\nU.P. Police Regulations.  We are satisfied that this  appeal<br \/>\nhas to be allowed.\n<\/p>\n<p>4.The\tappellant   has\t expressly  asserted   that   his<br \/>\nappointment  as\t a  Constable was on probation\tin  a  clear<br \/>\nvacancy.  On behalf of the State of U.P., there is no denial<br \/>\nof  this assertion and no material has been produced by\t the<br \/>\nState  to indicate that the appellant&#8217;s appointment was\t not<br \/>\nof this nature.\t There can be no doubt that the State  which<br \/>\nis in possession of the entire record was not in a  position<br \/>\nto  show  with\treference to the  record  that\tthe  factual<br \/>\nposition was different.\t The failure of the State Government<br \/>\nto produce any record in support of its submission is  alone<br \/>\nsufficient  to\treject its submission to this  effect.\t The<br \/>\ncase  has, therefore, to be examined on the basis  that\t the<br \/>\nappellant&#8217;s appointment was on probation in a clear  vacancy<br \/>\nwhich  was  governed by Regulation 541 of  the\tU.P.  Police<br \/>\nRegulations.\n<\/p>\n<p>5.Mere perusal of Regulation 541 shows that an inquiry is<br \/>\ncontemplated of the kind mentioned therein before any  order<br \/>\nof  discharge thereunder is made in a case like the  present<br \/>\nduring\tthe period of probation.  Admittedly that  procedure<br \/>\nwas  not adopted in the present case before terminating\t the<br \/>\nappellant&#8217;s   services.\t  The  order  of   termination\t is,<br \/>\ntherefore, obviously invalid.\n<\/p>\n<p>6.In  the  result,  the appeal\tis  allowed  with  costs.<br \/>\nConsequently, the impugned judgment of the High Court is set<br \/>\naside and writ petition filed in the High Court is  allowed,<br \/>\nwith consequential benefits.  The appellant is to get  costs<br \/>\nfrom respondent-State of U.P.
