Gupta, Advocate<\/p>\n<p>MR.JUSTICE J.P.SINGH, JUDGE<br \/>\nDate : 20\/11\/2008<br \/>\n:Judgment :\n<\/p>\n<p>______________________________________________________________________<br \/>\nNot satisfied with the quantum of compensation<br \/>\nawarded to her as compensation by the Motor Accidents<br \/>\nClaims Tribunal Jammu, for the injuries she had sustained on<br \/>\nJuly 13, 2000 when she had been hit by brashly and<br \/>\nnegligently driven truck no. JK02L-0945 by Amarjeet Singh<br \/>\nrespondent, Mrs. Vijay Laxmi appellant has filed this appeal<br \/>\nseeking enhancement of the amount of compensation.<br \/>\nAppellant&#8217;s learned counsel Mr. B. D. Sundan<br \/>\nsubmitted that the Tribunal has erred in assessing appellant&#8217;s<br \/>\nloss of amenities of life at Rs. 30,000\/- and for pain and<br \/>\nsufferings at Rs. 20,000\/-. According to him the evidence<br \/>\nproduced by the appellant would warrant substantial increase<br \/>\nion the amount of compensation to which the appellant would<br \/>\nbe entitled to.\n<\/p>\n<p>Insurance Company&#8217;s counsel Mr. R. K. Gupta justifies the<br \/>\naward saying that the Tribunal&#8217;s award for an amount of Rs.<br \/>\n61,935\/- reflected just amount of compensation and no<br \/>\nincrease therein is warranted.\n<\/p>\n<p>I have considered the submissions of learned counsel<br \/>\nfor the parties, gone through the award of the Tribunal and<br \/>\nthe opinion of the Chairman Standing Medical Board,<br \/>\nGovernment Medical College and Associated Hospitals<br \/>\nJammu.\n<\/p>\n<p>As the short question which arises for consideration in<br \/>\nthis appeal is only regarding the assessment of just<br \/>\ncompensation for the injuries received by the appellant in the<br \/>\nmotor vehicular accident arising out of negligent driving of<br \/>\nvehicle No. JK02L-0945 by its driver Amarjeet Singh,<br \/>\nrespondent no.1, so only few facts are needed to be noticed<br \/>\nfor resolution of the question.\n<\/p>\n<p>Appellant&#8217;s age at the time of the accident is stated to<br \/>\nbe around 40 years. While rejecting her claim that she had<br \/>\nbeen earning Rs. 4000\/- per month by stitching clothes, the<br \/>\nTribunal has not assessed her income for the contribution she<br \/>\nhad been meeting to the family as a house wife. The Tribunal<br \/>\nhas assessed an amount of Rs. 30,000\/- as compensation for<br \/>\nloss of amenities of life but without furnishing any reasons in<br \/>\nsupport thereof.\n<\/p>\n<p>In order to assess just compensation payable either to<br \/>\ndependents of the deceased or to an injured victim of the<br \/>\nmotor vehicular accident, in terms of Section 168 of the<br \/>\nMotor Vehicles Act, 1988, the Tribunal is required first to<br \/>\nassess the monthly income of the deceased\/injured and it is<br \/>\nonly when such assessment is made, of course supported by<br \/>\nreasons for such assessment, that the Tribunal may proceed<br \/>\nfurther to assess the compensation in terms of Section 168 of<br \/>\nthe Act. The Tribunal shall, while making assessment of<br \/>\ncompensation, keep in mind the parameters which the<br \/>\nParliament in its wisdom has prescribed in the Second<br \/>\nSchedule issued under Section 163-A of the Act for<br \/>\nassessment of compensation for third party fatal<br \/>\naccident\/injury cases claims.\n<\/p>\n<p>The Tribunal does not appear to have taken into<br \/>\naccount the above mentioned parameters and has arrived at a<br \/>\nfigure as compensation for loss of amenities of life, which<br \/>\nfinding of the Tribunal is nothing bit arbitrary, which may<br \/>\nnot warrant acceptance.\n<\/p>\n<p>Keeping in view the fact that the appellant had received<br \/>\ninjuries in the year 2000, I do not find it appropriate to<br \/>\nremand the case to the Tribunal for assessment of the<br \/>\ncompensation afresh and would consider appellant&#8217;s case on<br \/>\nthe evidence which had been adduced before the Tribunal to<br \/>\nassess just compensation.\n<\/p>\n<p>While assessing compensation in case of bodily injury,<br \/>\nthe Tribunal should consider all relevant factors so as to<br \/>\nenable the injured to be put in the same condition as if he\/she<br \/>\nhad not sustained any injury. The principle of restitution-<br \/>\ninintegrum<br \/>\nshould always remain in the mind of the tribunal<br \/>\nwhile assessing compensation under various heads.<br \/>\nGoing by the law as settled by Hon&#8217;ble Supreme Court<br \/>\nof India in <a href=\"\/doc\/508534\/\">Lata Wadhwa vs. State of Bihar,<\/a> reported as 2001<br \/>\nACJ, 1735 and taking the monthly income of the appellant,<br \/>\nwho is a house wife, at Rs. 3000\/- being her contribution to<br \/>\nthe family, and keeping in view the 15% permanent disability<br \/>\nwhich she had suffered because of sustaining grievous<br \/>\ninjuries in the motor vehicular accident and above all that she<br \/>\nhas to live the life of a disabled limping women all through<br \/>\nher life, loss of amenities of life to her is assessed by taking<br \/>\n16, the prescribed multiplier for the age of persons like the<br \/>\nappellant, as it so appears in the Second Schedule, at Rs.<br \/>\n38,400\/-, which when rounded off would come to Rs.<br \/>\n39,000\/-.\n<\/p>\n<p>Compensation awarded by the Tribunal for pain and<br \/>\nsufferings too appears to be on the lower side. In view of the<br \/>\nfacts and circumstances of the case and keeping in mind the<br \/>\nprinciple of restitution-in-integrum, I am of the opinion that<br \/>\nas against an amount of Rs. 20,000\/- awarded by the Tribunal<br \/>\nto the appellant for her pain and sufferings, an amount of Rs.<br \/>\n25,000\/- would be just compensation.\n<\/p>\n<p>The total compensation to which the appellant would be<br \/>\nentitled to comes to Rs. 75,935\/- which includes an amount<br \/>\nof Rs. 6,935\/- being spent by the appellant for her treatment<br \/>\nand an amount of Rs. 5000\/- spent by her for her special diet.<br \/>\nFor all what has been said above, this appeal therefore<br \/>\nsucceeds and is accordingly allowed modifying the<br \/>\nTribunal&#8217;s award to be an award of Rs. 75,935\/- along with<br \/>\ninterest as granted by the Tribunal.
