Justice S.SIRI JAGAN\n\n Dated :11\/06\/2008\n\n O R D E R\n                           S.SIRI JAGAN, J\n                     = = = = = = = = = = = = = = = =\n                      W.P.(C).No. 17104 OF 2008\n                       = = = = = = = = = = = = =\n                  Dated this the 11th day of June, 2008.\n\n                            J U D G M E N T\n<\/pre>\n<p>      The petitioners are M.B.B.S students who were already<\/p>\n<p>completed the course.         They want to write the final year<\/p>\n<p>examination. However, they could not do so, since they have not<\/p>\n<p>passed the previous examination in all subjects.           The rule<\/p>\n<p>stipulates that a candidate can appear for final year examination<\/p>\n<p>only after passing the previous examination in full.           The<\/p>\n<p>petitioners seek permission to write the final year examination<\/p>\n<p>subject to passing of 2nd year examination relaxing the rule.<\/p>\n<p>Petitioners now submit that they have filed Exts.P5 to P8<\/p>\n<p>representations in the matter before the 1st respondent. They<\/p>\n<p>now confine their relief for a direction to the 1st respondent to<\/p>\n<p>consider and pass orders on Exts.P5 to P8 in accordance with law.<\/p>\n<p>      2.   I have heard the learned standing counsel appearing<\/p>\n<p>for the University also.\n<\/p>\n<p>      3.   In the facts and circumstances of the case, without<\/p>\n<p>expressing any opinion on the merits of the petitioners&#8217; claim, I<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No. 17104 OF 2008          2<\/span><\/p>\n<p>direct the 1st respondent to consider and pass orders on Exts.P5<\/p>\n<p>to P8 representations in accordance with the rules, as<\/p>\n<p>expeditiously as possible before 20th June, 2008.<\/p>\n<p>     The writ petition is disposed of as above.
