Justice K.T.SANKARAN\n\n Dated :15\/02\/2010\n\n O R D E R\n                           K.T.SANKARAN, J.\n              ------------------------------------------------------\n                        B.A. NO. 7528 OF 2009\n              ------------------------------------------------------\n              Dated this the 15th day of February, 2010\n\n\n                                 O R D E R\n<\/pre>\n<p>       When the Bail Application came up for hearing on 1.2.2010,<\/p>\n<p>the following order was passed:\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;This is an application for anticipatory bail under<\/p>\n<p>       Section 438 of the Code of Criminal Procedure. The<\/p>\n<p>       petitioners are accused Nos.1 and 2 in Crime No.594<\/p>\n<p>       of     2009     of    Balaramapuram           Police     Station,<\/p>\n<p>       Thiruvananthapuram.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>               2.     The     offences      alleged      against    the<\/p>\n<p>        petitioners are under Sections 454, 341 and 308 read<\/p>\n<p>        with Section 34 of the Indian Penal Code.<\/p>\n<\/blockquote>\n<blockquote><p>               3.     Heard     the    learned     counsel     for  the<\/p>\n<p>        petitioners and the learned Public Prosecutor. It is<\/p>\n<p>        seen that no serious injuries were sustained by the de<\/p>\n<p>        facto complainant.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>               4.     Taking     into   account      the    facts   and<\/p>\n<p>        circumstances of the case, I am of the view that before<\/p>\n<p>        disposing of the Bail Application, an opportunity should<\/p>\n<p>B.A. NO. 7528 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p><\/blockquote>\n<blockquote><p>       be given to the petitioners to appear before the<\/p>\n<p>       investigating officer. Accordingly, there will be a<\/p>\n<p>       direction to the petitioners to appear before the<\/p>\n<p>       investigating officer at 9 A.M. on 8th and 9th February,<\/p>\n<p>       2010.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              5.    Post on 15\/02\/2010.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              6.    It is submitted by the learned Public<\/p>\n<p>       Prosecutor that the petitioners will not be arrested until<\/p>\n<p>       further orders in connection with Crime No.594 of<\/p>\n<p>       2009 of Balaramapuram Police Station.<\/p>\n<\/blockquote>\n<blockquote><p>             The petitioners shall produce copy of this order<\/p>\n<p>       before the investigating officer.&#8221;<\/p><\/blockquote>\n<p>      2. It is submitted by the learned counsel for the petitioners as<\/p>\n<p>well as the learned Public Prosecutor that the direction in the order<\/p>\n<p>dated 1.2.2010 has been complied with by the petitioners.<\/p>\n<p>      3. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact that<\/p>\n<p>the direction in the order dated 1.2.2010 has been complied with by<\/p>\n<p>the petitioners, I am of the view that anticipatory bail can be granted<\/p>\n<p>B.A. NO. 7528 OF 2009<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<p>to the petitioners. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioners, the officer in charge of the police station<\/p>\n<p>shall release them on bail on their executing bond for Rs.15,000\/-<\/p>\n<p>with two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>       a)    The petitioners shall appear before the investigating<br \/>\n             officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote><p>       b)    The petitioners shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;<\/p>\n<\/blockquote>\n<blockquote><p>       c)    The petitioners shall not commit any offence or indulge<br \/>\n             in any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<blockquote><p>       d)    In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>       The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p>                                                   (K.T.SANKARAN)<br \/>\n                                                           Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sajith Kumar vs State Of Kerala on 15 February, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7528 of 2009() 1.
