Mohan Singh and<br \/>\n\tothers, reported in  (2001) 9 SCC 717<br \/>\n\tsubmitted that the petitioners are aggrieved on account of<br \/>\n\tentertaining the Appeal which was preferred under the provisions of<br \/>\n\tthe Gujarat Land Revenue Rules 1972 and as per the provisions of<br \/>\n\tRule 108(5), the limitation is prescribed for 60 days and the appeal<br \/>\n\twas filed beyond the period of limitation and it was delayed by as<br \/>\n\tmany as 24 months. The averments in the memo of Appeal on the<br \/>\n\tcontrary indicated that the Appeal was in time. This factor should<br \/>\n\thave been appreciated by the Competent Authority.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri Vaghela appearing for respondent nos. 1 to 3 on caveat<br \/>\n\tcould not at this stage controvert this aspect at all, though he<br \/>\n\tsubmitted that the case of respondents was absolutely genuine and on<br \/>\n\tmerits as the entry was sought to be mutated after delay of 40<br \/>\n\tyears. Be that as it may.\n<\/p>\n<p>Let<br \/>\n\tthere be notice returnable on 30.11.2011. Shri Vaghela, learned<br \/>\n\tadvocate waives service of notice on behalf of respondent nos. 1 to\n<\/p>\n<p>\t3.
