The workman was neither given one month<br \/>\n\tnotice nor he was paid retrenchment compensation at the time of<br \/>\n\ttermination of his service. It is also the case of the petitioner<br \/>\n\tthat at the time of his termination, junior persons to the<br \/>\n\tpetitioner were continued and even after termination fresh<br \/>\n\trecruitments were made by the respondent.\n<\/p>\n<p>\tSimilarly the case of the<br \/>\n\tpetitioner in Special Civil Application No.15770 of 2010 is that he<br \/>\n\thas worked continuously for period of more than 5 years and his<br \/>\n\tservices were terminated from 25.5.1984. The rest of the averments<br \/>\n\tmade by the petitioner are same as that of Special Civil Application<br \/>\n\tNo.15769 of 2010.\n<\/p>\n<p>\tMr.Anand Gogia, learned<br \/>\n\tadvocate appearing for the petitioners in both these petitions, has<br \/>\n\tsubmitted that the Labour Court has not considered the settled legal<br \/>\n\tposition and despite the fact that the provisions of Section 25F,<br \/>\n\t25G and 25H of the Industrial Disputes Act were not complied with<br \/>\n\tand were violated. The Labour Court has merely passed an award of<br \/>\n\treinstatement without any back wages. He has, therefore, submitted<br \/>\n\tthat the impugned award passed by the Labour Court deserves to be<br \/>\n\tquashed and set aside. In any case the petitions require<br \/>\n\tconsideration by this Court and hence they are required to be<br \/>\n\tadmitted and appropriate direction be issued for awarding the back<br \/>\n\twages.\n<\/p>\n<p>\tHaving heard learned<br \/>\n\tadvocate appearing for the petitioner and having considered the<br \/>\n\taverments made in the petition as well as the impugned award passed<br \/>\n\tby the Labour Court, the Court is of the view that the petitioner is<br \/>\n\ta daily wager. He is not on regular pay-roll of the respondent. His<br \/>\n\tappointment is also without following the due procedure of law.<br \/>\n\tNeither they were recruited pursuant to any advertisement nor their<br \/>\n\tnames were called from the Employment Exchange. The Labour Court has<br \/>\n\ttaken into consideration all these aspects and decided case law on<br \/>\n\tsubject. One more fact which was taken into consideration by the<br \/>\n\tLabour Court is that though services of the petitioner were orally<br \/>\n\tterminated in May, 1984 they have preferred reference in the year<br \/>\n\t1996 i.e. after expiry of period of more than 12 years. Considering<br \/>\n\tall these aspects the Labour Court has passed an award of<br \/>\n\treinstatement but refused to grant back wages. The Court does not<br \/>\n\tfind any infirmity in the award passed by the Labour Court, as in<br \/>\n\tsuch cases the petitioners are only at the most entitled to some<br \/>\n\treasonable compensation. As against this the Labour Court has<br \/>\n\tgranted reinstatement and hence the Labour Court is justified in not<br \/>\n\tawarding any back wages in these cases. There is no merit in these<br \/>\n\tpetitions and hence both the petitions are accordingly dismissed<br \/>\n\twithout any order as to costs.\n<\/p>\n<p>\t                        (K.\n<\/p>\n<p>\tA.
