No.22852 of 2010\n                      CHINTU SINGH, SON OF LATE LAL BABU SINGH\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   13.07.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 25(1-b)A and 26 of the Arms Act.<\/p>\n<p>                             Considering that the petitioner is in custody since<\/p>\n<p>                  10.2.2010 for recovery of two miss-fired cartridges and has no<\/p>\n<p>                  criminal antecedents, let the petitioner above named, be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                  thousand) with two sureties of the like amount each to the<\/p>\n<p>                  satisfaction of Sub Divisional Judicial Magistrate, Bikramganj,<\/p>\n<p>                  Distt. Rohtas, in Karakat P.S. Case No. 25 of 2010 subject to<\/p>\n<p>                  the following conditions: (i)That one of the bailors will be a close<\/p>\n<p>                  relative of the petitioner who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner and the<\/p>\n<p>                  other shall be the mother of the petitioner. The bailor will<\/p>\n<p>                  undertake to furnish information to the court about any change<\/p>\n<p>                  in address of the petitioner. (ii)That the affidavit shall clearly<\/p>\n<p>                  state that the petitioner is not an accused in any other case and<\/p>\n<p>                  if he is, he shall not be released on bail. (iii)That the bailor shall<\/p>\n<p>                  also state on affidavit that he will inform the court concerned if<\/p>\n<p>                  the petitioner is implicated in any other case of similar nature<\/p>\n<p>                  after his release in the present case and thereafter the court<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        below will be at liberty to initiate the proceeding for cancellation<\/p>\n<p>        of bail on the ground of misuse. (iv)That the petitioner will give<\/p>\n<p>        an undertaking that he will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if he<\/p>\n<p>        fails to do so on two given dates and delays the trial in any<\/p>\n<p>        manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
