No.20222 of 2010:\n<\/p>\n<p>                                                      Mr. Vijay Anand,Adv.\n<\/p>\n<p>                   For the State : Mr. R.P.Singh, A.P.P.<\/p>\n<p>                                         &#8212;\n<\/p>\n<p>2\/   14.06.2010             Heard the parties.<\/p>\n<p>                            In a criminal prosecution for offence under<\/p>\n<p>                  section 379 of the Indian Penal Code the petitioners are<\/p>\n<p>                  not named in the F.I.R. as accused. The F.I.R., Annexure-<\/p>\n<p>                  1, was lodged with respect to the theft of a motorcycle.<\/p>\n<p>                            It is submitted that four motorcycles were seized<\/p>\n<p>                  from near Kuber Hotel, Exhibition Road, Patna and for that<\/p>\n<p>                  Gandhi Maidan P.S. Case No. 364 of 2009 was registered<\/p>\n<p>                  and there the petitioners were named as accused.<\/p>\n<p>                  Thereafter on mere suspicion in several other identical<\/p>\n<p>                  cases, including present one, the petitioners have been<\/p>\n<p>                  remanded as accused. Petitioner Vishwanath Panjiyar @<br \/>\n<span class=\"hidden_text\">                     -2-<\/span><\/p>\n<p>Vishwajit Kumar @ Bishu is said to be in judicial custody<\/p>\n<p>since   06.11.2009    and      petitioner   Mithelesh    Singh @<\/p>\n<p>Mithilesh Kumar Singh is said to be in judicial custody<\/p>\n<p>since 10.11.2009.\n<\/p>\n<p>          Be   that       as   it   may,    in   the    facts   and<\/p>\n<p>circumstances let the above named petitioners of both<\/p>\n<p>cases be enlarged on bail on furnishing bail bonds of Rs.<\/p>\n<p>10,000\/- each with two sureties of the like amount each to<\/p>\n<p>the satisfaction of Mr. Rajiv Kumar, J.M. Ist Class, Patna<\/p>\n<p>in Gandhi Maidan P.S. Case No. 346 of 2009 subject to the<\/p>\n<p>conditions :\n<\/p>\n<p> (A)            one of the bailors must be government<\/p>\n<p>                servant or close family members of the<\/p>\n<p>                petitioners, who will file an affidavit in the<\/p>\n<p>                court below showing his\/her relationship<\/p>\n<p>                with the petitioners,<\/p>\n<p> (B)            if the petitioners are found involved in<\/p>\n<p>                same and similar nature of cases in<\/p>\n<p>                future, then in that case the informant\/<\/p>\n<p>                prosecution shall be at liberty to file a<\/p>\n<p>                petition for cancellation of the bail of the<\/p>\n<p>                petitioners, and if such a petition is filed,<\/p>\n<p>                the court below would be obliged to<\/p>\n<p>                dispose of the same in accordance with<\/p>\n<p>                law after giving opportunity of hearing to<br \/>\n<span class=\"hidden_text\">                    -3-<\/span><\/p>\n<p>                 all concerned and<\/p>\n<p>           (C)   the petitioners shall make regular pairvi in<\/p>\n<p>                 the court below in the present case either<\/p>\n<p>                 by appearing themselves in person or<\/p>\n<p>                 through representation by their lawyer on<\/p>\n<p>                 each and every dates, and if on two<\/p>\n<p>                 consecutive dates petitioners fail to make<\/p>\n<p>                 pairvi, then the court below shall be at<\/p>\n<p>                 liberty to cancel the bail bonds of the<\/p>\n<p>                 petitioners.\n<\/p>\n<\/p>\n<p>                         ( Birendra Prasad Verma, J )<\/p>\n<p>BTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Vishwanath Panjiyar @ Vishwajit &#8230; vs The State Of Bihar on 14 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
