NO. 2026 OF 2008\n              = = = = = = = = = = = = = = =\n      Dated this the 17th day of September, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Neyyattinkara in O.P.(MV)110\/02.<\/p>\n<p>The claimant had sustained injuries in a road accident as a<\/p>\n<p>pillion rider in a vehicle and the Tribunal has awarded a<\/p>\n<p>compensation of Rs.17,000\/-. The insurance company took<\/p>\n<p>up the contention that being a pillion rider and the policy<\/p>\n<p>issued is without collecting additional premium, does not<\/p>\n<p>cover the pillion rider and so it has to be exonerated from<\/p>\n<p>the liability.\n<\/p>\n<p>      In paragraph 13 of the award the Tribunal held that it is<\/p>\n<p>a comprehensive policy and relying on the decision of this<\/p>\n<p>Court reported in <a href=\"\/doc\/542594\/\">Mathew Joseph v. Janaki<\/a> (2007 (1)<\/p>\n<p>KLT 747(FB) took the stand that the insurance company is<\/p>\n<p>liable to pay the amount. The said approach of the Tribunal<\/p>\n<p>cannot be appreciated. Comprehensive policy by itself does<\/p>\n<p>not mean that it covers the risk of a pillion rider. But being a<\/p>\n<p>M.A.C.A. 2026 OF 2008<br \/>\n<span class=\"hidden_text\">                              -:2:-<\/span><\/p>\n<p>B policy the conditions attached to the B policy especially<\/p>\n<p>clause II 1(i) deals with a situation where the insurance<\/p>\n<p>company as per the terms and conditions of the policy<\/p>\n<p>undertakes to cover the risk of a person who is carried in<\/p>\n<p>motorcycle other than for hire or reward. This position was<\/p>\n<p>considered by a Division Bench of this Court reported in New<\/p>\n<p>India Assurance Co. Ltd. v. Hydrose [2008 (3) KHC<\/p>\n<p>522(DB)]. This Court held that in such cases the insurance<\/p>\n<p>company cannot escape from the liability. In the light of the<\/p>\n<p>said decision the contention of the insurance company<\/p>\n<p>cannot be entertained. Therefore the appeal is dismissed.<\/p>\n<p>                          M.N.
