Justice K.BALAKRISHNAN NAIR\n\n Dated :11\/07\/2007\n\n O R D E R\n                     K.BALAKRISHNAN NAIR,J.\n\n                           -------------------------\n\n              CONTEMPT CASE (C )No. 902 of 2007\n\n                           --------------------------\n\n               Dated this the 11th day of July, 2007\n\n\n                             J U D G M E N T\n<\/pre>\n<p>      The   petitioners   are   the          retired   employees   of   the<\/p>\n<p>Transformers   and   Electricals   Kerala   Ltd.,   Angamaly.     Two<\/p>\n<p>persons   similarly   placed   like   the   petitioners   approached   this<\/p>\n<p>court   by filing O.P.3687\/2001 claiming arrears of salary arising<\/p>\n<p>out of revision of salary with retrospective effect from 1.9.1996.\n<\/p>\n<p>They retired from service after the said revision.  Their claim for<\/p>\n<p>arrears of salary  from 1.9.1996 to 31.12.1997 was conceded by<\/p>\n<p>the Company and  writ petition was disposed of directing them to<\/p>\n<p>pay the entire arrears of salary as and when funds  are available.\n<\/p>\n<p>Claiming   similar   reliefs,   petitioners   herein   approached   this<\/p>\n<p>court.   The said     W.P.(C) No. 29529 \/2003   was disposed of by<\/p>\n<p>judgment   dated   20.10.2003,   directing     to     extend   the     same<\/p>\n<p>treatment   meted out to the petitioners in O.P.3687\/2001 to the<\/p>\n<p>petitioners herein also.   Alleging that the said direction has not<\/p>\n<p>been   obeyed,   this   Contempt   Case   is   filed.     The   respondent   has<\/p>\n<p>filed a statement stating that the arrears of salary payable to the<\/p>\n<p>petitioners under the judgment have already been released.  The<\/p>\n<p>CONTEMPT CASE (C )No.    902 of 2007<\/p>\n<p><span class=\"hidden_text\">                                          -2-<\/span><\/p>\n<p>Petitioners   submit   some D.A arrears in relation to subsequent<\/p>\n<p>periods are not disbursed.   The said claim is not covered by the<\/p>\n<p>above-mentioned   judgment.     So,   for   non-payment   of   the   same<\/p>\n<p>contempt   proceedings   cannot   be   initiated   against   the<\/p>\n<p>respondents.
