Ahiyapur, District Muzaffarpur.\n                                                ------- Petitioner\n                               Versus\nThe State of Bihar                               ----- Opp. Party\n                            -----------\n<\/pre>\n<p>3       09.08.2010              Heard          learned         counsel         for      the<\/p>\n<p>                     petitioner and counsel for the State.<\/p>\n<p>                                Earlier the prayer for bail of the<\/p>\n<p>                     petitioner       was      rejected        by    an    order      dated<\/p>\n<p>                     26.3.2009 in Cr. Misc. No. 50814 of 2008 with<\/p>\n<p>                     an observation that the petitioner may renew<\/p>\n<p>                     his prayer for bail after completing one year<\/p>\n<p>                     of   further        custody     from      the     date      of    such<\/p>\n<p>                     order.\n<\/p>\n<p>                                In          view          of        the        aforesaid<\/p>\n<p>                     observation, as the petitioner has already<\/p>\n<p>                     completed        one       further        year       of     judicial<\/p>\n<p>                     custody from the date of rejection of his<\/p>\n<p>                     prayer for bail, this Court would direct for<\/p>\n<p>                     release     of      the     petitioner,          namely,         Munni<\/p>\n<p>                     Paswan @ Babajee on bail on furnishing bail<\/p>\n<p>                     bond of Rs. 10,000\/- (ten thousand) with two<\/p>\n<p>                     sureties       of    the      like    amount         each    to   the<\/p>\n<p>                     satisfaction         of    Chief      Judicial        Magistrate,<\/p>\n<p>                     Muzaffarpur in connection with Ahiyapur P.S.<\/p>\n<p>                     Case     No.     202       of   2008,          subject      to    the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>      following conditions:-\n<\/p>\n<p>      (i)     The        two         bail         bonds        will         be<\/p>\n<p>              furnished,            one      by     the     Government<\/p>\n<p>              servant         and     the    other        by     a    close<\/p>\n<p>              family relative.\n<\/p>\n<p>      (ii)    The       petitioner          will    remain       present<\/p>\n<p>              in course of trial on each and every<\/p>\n<p>              day       and     his       absence         even       for     a<\/p>\n<p>              single           day        would       automatically<\/p>\n<p>              entail            the          consequences                   of<\/p>\n<p>              cancellation of his bail.\n<\/p>\n<p>      (iii)   The petitioner in case is now made<\/p>\n<p>              accused in any other criminal case,<\/p>\n<p>              that            would         itself          lead            to<\/p>\n<p>              cancellation of his bail.\n<\/p>\n<p>              Subject           to        the        aforementioned<\/p>\n<p>      conditions,       the     prayer       for     bail        of        the<\/p>\n<p>      petitioner is allowed.\n<\/p>\n<\/p>\n<pre>Rsh                                       (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Munni Paswan @ Babajee vs The State Of Bihar on 9 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
