P.C. in connection with CR No. I-166 of 2011<br \/>\nregistered with Gorwa Police Station, Vadodar,  for the offences<br \/>\npunishable under Sections-498-A, 207, 315 and 114 of the Indian Penal<br \/>\nCod and Sections-3 and 7 of the Dowry Prohibition Act.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate appearing for applicant has contended from the papers, it<br \/>\nappears that presence of applicant-accused is not established and<br \/>\nlooking to the role attributed to the applicant, it appears that<br \/>\napplicant is falsely implicated in the offence alleged against her<br \/>\nwith ulterior motive, therefore, the applicant may be released on<br \/>\nbail.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP has vehemently opposed this application.  However, both the<br \/>\nlearned advocates do not press for reasoned order.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the learned Counsel for the parties, perusing the record and<br \/>\nconsidering the facts of the case, it appears that applicant-accused<br \/>\nis sister-in-law of the victim and falsely implicated in the offence<br \/>\nalleged against her.  As there is no definite allegations made<br \/>\nagainst the applicant-accused, I am inclined to grant anticipatory<br \/>\nbail to the applicant-accused.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein<br \/>\nbeing arrested pursuant CR No. I-166 of 2011, registered with<br \/>\nGorwa Police Station, Vadodra the applicant shall be released on Bail<br \/>\non her furnishing a Bond of Rs.10,000\/- (Rupees ten thousand only)<br \/>\nwith one surety of like amount on condition that &#8211;\n<\/p>\n<p>a)\tshe<br \/>\nshall co-operate with the investigation and make herself available<br \/>\nwhenever required;\n<\/p>\n<p>b)\tshe<br \/>\nshall remain present before the Investigating Officer, Gorwa Police<br \/>\nStation, Vadodara, on 10th October, 2011<br \/>\nat 11.00 a.m.<\/p>\n<p>c)\tshe<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them for disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>d)\tAt<br \/>\nthe time of execution of Bond, she shall furnish her address to the<br \/>\nI.O. and the Court concerned and shall not change the residence till<br \/>\nthe final disposal of the case or till further orders;\n<\/p>\n<p>e)\tthat<br \/>\nshe will not leave India without the permission of the Court and, if<br \/>\nis holding a Passport, surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>f)\tIt<br \/>\nwould be open to the Investigating Officer to \tfile an application<br \/>\nfor remand, if considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits;\n<\/p>\n<p>g)\tthis<br \/>\norder will be operative if the applicant is arrested at any time<br \/>\nwithin a period of 90 days;\n<\/p>\n<p>h)\twithin<br \/>\na period of ten days from the date of arrest, the applicant shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate for the applicant assured that applicant will appear before<br \/>\nconcerned police station as per direction of this Court.\n<\/p>\n<p>7.\tWith<br \/>\nthese directions, this Criminal Miscellaneous Application is disposed<br \/>\nof. Rule is made absolute.
