SANKARAN, J.\n                       ------------------------\n                      B.A. No. 1876 of 2010\n                 ------------------------------------\n               Dated this the 30th day of March, 2010\n\n                             O R D E R\n<\/pre>\n<p>      This is an application for bail under Section 439 of the Code<\/p>\n<p>of Criminal Procedure. The petitioner is accused No.2 in Sessions<\/p>\n<p>Case   No. 134\/2010 on the file of the Court of the Additional<\/p>\n<p>Sessions, Judge, Kasaragod.\n<\/p>\n<p>      2. The offences alleged against the petitioner are under<\/p>\n<p>Sections 332 and 307 of the Indian Penal Code.<\/p>\n<p>      3. The date of occurrence was on 25.04.2002.              The<\/p>\n<p>petitioner was arrested on 25.04.2002 itself. It is stated that he<\/p>\n<p>was released on bail at the crime stage.           The case of the<\/p>\n<p>petitioner is that he did not receive summons in the case.<\/p>\n<p>Anyhow, the presence of the petitioner could not be secured<\/p>\n<p>before the Court for about 7 years. According to the petitioner,<\/p>\n<p>he was working in Mumbai.(order passed by the Additional<\/p>\n<p>Sessions Judge, Kasaragod says that the petitioner was working<\/p>\n<p>abroad. The learned counsel for the petitioner submitted that this<\/p>\n<p>is not fully correct.)<\/p>\n<p><span class=\"hidden_text\">B.A. No. 1876 \/ 2010            2<\/span><\/p>\n<p>        4. The petitioner surrendered before the Additional Sessions<\/p>\n<p>Court on 01.03.2010 and he was remanded to judicial custody.<\/p>\n<p>Application for bail filed by the petitioner was dismissed by the<\/p>\n<p>Additional Sessions Judge, Kasaragod as per the order dated<\/p>\n<p>11.03.2010.\n<\/p>\n<p>        5. The learned counsel for the petitioner submitted that the<\/p>\n<p>petitioner is prepared to comply with any condition that may be<\/p>\n<p>imposed by the Court. The petitioner also assures that he would<\/p>\n<p>be present in Court during the trial of the case and that there will<\/p>\n<p>be no room for any complaint that he absconded.                 This<\/p>\n<p>submission is recorded.\n<\/p>\n<p>        6. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner on stringent conditions.\n<\/p>\n<p>         7. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.50,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Additional Sessions Judge<\/p>\n<p>(Adhoc-II), Kasaragod subject to the following conditions:-<\/p>\n<p><span class=\"hidden_text\">B.A. No. 1876 \/ 2010              3<\/span><\/p>\n<blockquote><p>                 A) The petitioner shall report before the Station<br \/>\n                     House Officer, Bedakadm Police Station<br \/>\n                     between 9 A.M. and 11 A.M. on every<br \/>\n                     Monday, till the trial of the case is over.\n<\/p><\/blockquote>\n<blockquote><p>                 B)  The petitioner shall surrender his passport<br \/>\n                     before the Court of the Additional Sessions<br \/>\n                     Judge(Adhoc-II), Kasaragod within one<br \/>\n                     week from the date of release on bail. If<br \/>\n                     the petitioner does not hold an Indian<br \/>\n                     Passport, an affidavit sworn to by him to<br \/>\n                     that effect shall be filed before the learned<br \/>\n                     Additional Sessions Judge within one week.\n<\/p><\/blockquote>\n<blockquote><p>                 C) The petitioner shall not try to influence the<br \/>\n                     prosecution witnesses or tamper with the<br \/>\n                     evidence.\n<\/p><\/blockquote>\n<blockquote><p>                 D) The petitioner shall not commit any offence<br \/>\n                     or indulge in any prejudicial activity while<br \/>\n                     on bail.\n<\/p><\/blockquote>\n<blockquote><p>                 E)  In case of breach of any of the conditions<br \/>\n                     mentioned above, the bail shall be liable to<br \/>\n                     be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>         The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                      K.T.
