SUNIL KUMAR S\/O NOT KNOWN TO THIS PETITIONER ASSISTANT- MODANGANJ BLOCK,\nDISTT.- JEHANABAD\n\nAdvocate for respondent Nos.6 and 7: Shri Ramakant Sharma, Sr. Adv.\n                                  -----------\n<\/pre>\n<p>3\/    15\/03\/2011                Heard learned counsel for the petitioner,<\/p>\n<p>                     the State and respondent Nos.6 and 7.\n<\/p>\n<p>                                While the petitioner is stated to be an<\/p>\n<p>                     elected member of the Panchayat Samiti, Modanganj,<\/p>\n<p>                     District- Jehanabad, respondent Nos.6 and 7 are<\/p>\n<p>                     stated to be the Pramukh and the Assistant. The<\/p>\n<p>                     controversy relates to what the petitioner alleges an<\/p>\n<p>                     illegal   construction        of    a   building      for   medical<\/p>\n<p>                     treatment    of     animals        at   village-Charui,      Block-<\/p>\n<p>                     Modanganj,        District-    Jehanabad.        It    is   not   in<\/p>\n<p>                     controversy that during the pendency of the writ<\/p>\n<p>                     application the construction has been completed in<\/p>\n<p>                     March, 2010 itself. While the petitioner alleges that<\/p>\n<p>                     the construction has been made at the present<\/p>\n<p>                     location without any resolution of the Panchayat<\/p>\n<p>                     Samiti,     the      State         Authorities     and      private<\/p>\n<p>                     respondents 6 and 7 assert that the construction<\/p>\n<p>                     has been located at a place approved by the<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>Panchayat Samiti.\n<\/p>\n<p>          Arguments, counter arguments, allegations<\/p>\n<p>and counter allegations have been made with regard<\/p>\n<p>to what may have been considered by the Panchayat<\/p>\n<p>Samiti, in what manner it was considered by the<\/p>\n<p>Panchayat Samiti and to what extent it may have<\/p>\n<p>been considered by the Panchayat Samiti. At the<\/p>\n<p>fulcrum of the entire controversy are the decisions of<\/p>\n<p>the Panchayat Samiti which is best known to the<\/p>\n<p>members of the Panchayat Samiti itself.<\/p>\n<p>          The     Panchayat      system,      grassroots<\/p>\n<p>democracy, is a mandate of the Constitution. The<\/p>\n<p>Court need not go into that aspect further except to<\/p>\n<p>hold that grassroots democracy has to be allowed to<\/p>\n<p>function with full force and effect and shall not be<\/p>\n<p>interfered with by this Court lightly.<\/p>\n<pre>          Let       the     Deputy         Development\n\nCommissioner-cum-Chief        Executive    Officer,   Zila\n\n<\/pre>\n<p>Parishad, Jehanabad ensure that the aspect of the<\/p>\n<p>construction of the building for medical treatment of<\/p>\n<p>animals as discussed in the present order is placed<\/p>\n<p>before the Panchayat Samiti which shall examine for<\/p>\n<p>itself whether it had given any approval. If it had, for<\/p>\n<p>what location. It shall be the discretion of the<\/p>\n<p>Panchayat Samiti to decide\/ratify\/regularise what<\/p>\n<p>has to be done with the construction made, if it has<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>     been made without its resolution or at a place<\/p>\n<p>     contrary to its resolution.
