(ORAL)\n<\/pre>\n<p>          This writ petition has been filed by      the National<\/p>\n<p>Insurance Company Limited against the award dated 06.11.2008<\/p>\n<p>passed by the Permanent Lok Adalat (Public Utility Services),<\/p>\n<p>Ferozepur, whereby a sum of Rs.20,000\/- (with Rs.1000\/- as<\/p>\n<p>costs) has been awarded to respondent No.2-a farmer on account<\/p>\n<p>of the unnatural death of his buffalo, which was admittedly<\/p>\n<p>insured with the petitioner-company.\n<\/p>\n<p>          The instant petition exposes the sorry state of affairs<\/p>\n<p>as to how the Statutory Corporation or Government Company<\/p>\n<p>like the petitioner also indulge in frivolous and avoidable<\/p>\n<p>litigation, thereby burdening the Court dockets.<br \/>\n<span class=\"hidden_text\"> C.W.P NO. 2252 OF 2009                                -2-<\/span><\/p>\n<p>             It is an admitted fact that respondent No.2-claimant-a<\/p>\n<p>farmer got his buffalo insured for the value of Rs.20,000\/- on<\/p>\n<p>28.11.2006 with the petitioner-company. The insurance took<\/p>\n<p>place through the office of Deputy Director, Animal Husbandry at<\/p>\n<p>Ferozepur and the Senior Veterinary Officer, Civil Veterinary<\/p>\n<p>Hospital, Zira, District Ferozepur. Unfortunately, the buffalo died<\/p>\n<p>on 12.03.2007 due to fever and its post mortem was also<\/p>\n<p>conducted on the same day by the Veterinary Surgeon of the<\/p>\n<p>Veterinary    Hospital,    village     Bhagoke.   Respondent   No.2-the<\/p>\n<p>farmer submitted his claim form through the Civil Veterinary<\/p>\n<p>Hospital of the village on 16.03.2007 which was duly forwarded<\/p>\n<p>to the petitioner-company. The claimant did not hear anything for<\/p>\n<p>a sufficiently long period of time, despite a legal notice having<\/p>\n<p>been served on his behalf. Thereafter, he filed a claim petition<\/p>\n<p>before the Permanent Lok Adalat (Public Utility Services) at<\/p>\n<p>Ferozepur.\n<\/p>\n<p>             Two objections were taken by the petitioner-company<\/p>\n<p>on merits. Firstly, it was alleged that the claim petition was<\/p>\n<p>forwarded by the Civil Veterinary Hosptial Authorities after eight<\/p>\n<p>months and that the &#8220;year tag&#8221; of the buffalo did not accompany<\/p>\n<p>the claim application.\n<\/p>\n<p>             The impugned award reveals that the Permanent Lok<\/p>\n<p>Adalat   adjourned        the   case    for   01.10.2008,   16.10.2008,<\/p>\n<p>24.10.2008 and 06.11.2008 respectively for conciliation, but no<\/p>\n<p>responsible officer put in an appearance on behalf of the<br \/>\n<span class=\"hidden_text\"> C.W.P NO. 2252 OF 2009                              -3-<\/span><\/p>\n<p>petitioner-company. It was thereafter only that the Permanent<\/p>\n<p>Lok Adalat proceeded to decide the claim on merits.<\/p>\n<p>             The Permanent Lok Adalat has found, as a matter of<\/p>\n<p>fact, that the buffalo was insured; the buffalo died on account of<\/p>\n<p>fever; the claim form was submitted by the claimant within three<\/p>\n<p>days of the death i.e on 16.03.2007; the only procedural<\/p>\n<p>defeciency in the claim form was lack of verification by the Senior<\/p>\n<p>Veterinary Officer, Civil Veterinary Hospital, Zira and that it was<\/p>\n<p>not submitted in duplicate, for which the claimant was again<\/p>\n<p>called on 07.11.2007 when he submitted the application in<\/p>\n<p>duplicate.    Yet   the    payment   was   not   released.   In   these<\/p>\n<p>circumstances, the Permanent Lok Adalat proceeded to decide<\/p>\n<p>the case on merits and has passed the impugned award.<\/p>\n<p>             Being conscious of the fact that this Court in exercise<\/p>\n<p>of its writ jurisdiction will not travel into the factual conclusions,<\/p>\n<p>learned counsel for the petitioner submits that in view of the<\/p>\n<p>judgment of Hon&#8217;ble Supreme Court in the case of &#8220;<a href=\"\/doc\/1894467\/\">United India<\/p>\n<p>Insurance Company Limited vs. Manubhai Dharamsinhbhai<\/p>\n<p>Gajera<\/a>&#8221;      2008   (10)     Supreme   Court       Cases     404, the<\/p>\n<p>Permanent Lok Adalat (Public Utility Services), had no jurisdiction<\/p>\n<p>to entertain the claim petition and as such, the impugned award<\/p>\n<p>is without jurisdiction.\n<\/p>\n<p>             Having heard learned counsel for the petitioner at<\/p>\n<p>some length, I am of the considered view that there is no merit in<\/p>\n<p>this writ petition. The Permanent Lok Adalat meant and has done<br \/>\n<span class=\"hidden_text\"> C.W.P NO. 2252 OF 2009                                -4-<\/span><\/p>\n<p>substantial justice to a poor farmer and the Award warrants no<\/p>\n<p>interference by this Court for more than one reason. Firstly, no<\/p>\n<p>plea regarding lack of jurisdiction was taken before the Lok<\/p>\n<p>Adalat at the time of arguments. Having taken a chance before<\/p>\n<p>the Permanent Lok Adalat, it is too late to urge that the said Fora<\/p>\n<p>had no authority to decide the lis.\n<\/p>\n<p>           Secondly, there is no legal necessity to relegate the<\/p>\n<p>parties to an alternative Forum as no serious issue is found<\/p>\n<p>involved in this case. It would not only defeat the cause of<\/p>\n<p>justice, but would encourage the cantecourous and mighty<\/p>\n<p>litigants like the petitioner-company to prolong the agony of a<\/p>\n<p>light weight opponent. Thirdly, the facts that the buffalo was<\/p>\n<p>insured, it died an unnatural death and the claim had not become<\/p>\n<p>time barred, being not in dispute, a writ Court requires no other<\/p>\n<p>material to direct on its own for the release of due payment to<\/p>\n<p>the   respondent-farmer.    Besides   this,    the    conduct   of   the<\/p>\n<p>petitioner-company    who   had   shown       scant   respect   to   the<\/p>\n<p>institution of Permanent Lok Adalat, is yet another circumstance<\/p>\n<p>to dissuade this Court from interfering into the impugned award.<\/p>\n<p>           For the reasons mentioned above, I find no merit in<\/p>\n<p>this petition and the same is accordingly dismissed.<\/p>\n<pre>FEBRUARY 12, 2009                              (SURYA KANT)\nshalini                                            JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court National Insurance Co.
