\nin R.A.No. 10\/ 1998 on the file of the Addl. Civil Judge (S],”l:}:}Il’.}.  T’<\/p>\n
and JMFC, Puttur, D.K. allowing the appeal and  .<\/p>\n
This appeal coming on for admission    .’<\/p>\n

Heard the learn.ed cotinsel The
\nappellants were the defendants’   in a suit
\nfor bare in3’uncti*o1′;::\u00a3l.”  r’es:poiid.er\u00e9’tLplaintiff had
\ncontended, that  granted land and that
\nsubsequently; llll  same and had
\nconstructed  portion of the same which
\nwere assigned “by the local authority and the<\/p>\n
defegnldants   to stay in the said house under<\/p>\n
 perrnissivfe poccfupaticri. The defendants had occupied the<\/p>\n
 in the  T1982 and 1988, respectiveiy. However.<\/p>\n
 started to interfere with the rest of the property,<\/p>\n
‘V”V\u00bb”.”.over’~__wl1ic’ii’A–they had no right, the plaintiff had no alternative<\/p>\n
 ‘ ‘\ufb01le the suit seeking the relief of injunction. The suit<\/p>\n
 resisted on the ground that the defendants were<\/p>\n

\nadmittedly in occupation of the property and the defendants<\/p>\n
proceeded on the plea that the land belonged to_.._t_he<\/p>\n
Government and they were in occupation of the same ..u<\/p>\n
only available ingress and egress to their’r__es–identiallthouses’. ”<\/p>\n
through the suit property and    of
\ngranting injunction in favourfgdid noVt”ar”ise and
\nfurther the plaintiffs claim that  owner of
\nthe land, is belied  ‘fact grant was the
\nsubject matter     .l’::lbei’ored the Assistant
\nCommissioneh   an order of stay of
\nsuch grant and  was produced before the
\nCourt. The; trial   the contentions, particularly<\/p>\n
that lflthere’  “an adrhission by the plaintiff that the<\/p>\n
 defenld’ar1t.s  in portions of the suit property and<\/p>\n
 further ci,;”cunistance that the order of grant made in<\/p>\n
l  the plaintiff, was stayed by the competent authority,<\/p>\n
 the plaintiff was not entitled to an order of<\/p>\n
 .f,v_inju_4n’c’tion in the absence of absolute title being shown and<\/p>\n
admitted circumstance that the defendants were in fact<\/p>\n

possession against the Government and that such a <\/p>\n
not tenable, since unless the title of the  V’<\/p>\n
admitted. it was not possible for the”defendant.l<\/p>\n
adverse possession. It is in those circurnst.ances’._–.the ‘loVV–=,\/herd”<\/p>\n
appellate court has reversed the  of
\nhas held that the admitted*…_possess’iloiimizrip sollfar the
\ndefendants occupying the  on the suit
\nproperty not  could only
\ncontinue in  li5:\u00a7o’15erty and till such
\ntime, other    appellants. the defendants
\ncannot interfere  extent of the suit property
\nand cannotqcapusel’ damage as was complained of<\/p>\n
 ldecreedllllthe suit. It is that, which is in<\/p>\n

 As seen from the above circumstances, there are no<\/p>\n
ll”l\u00bb.l_’*suhstantiai’jquestions of law that would arise. T he findings<\/p>\n
ll”._are’l..:Vclear \ufb01ndings of fact. There is no infirmity in the<\/p>\n
it s<\/p>\n
reasoning of ihe appellate court. Therefore the <\/p>\n
rejected.\n<\/p>\n
