Balachandran, J.\n            --------------------------\n             W.P.(C)No.2519 of 2009 Y\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner is the sixth judgment debtor in E.P.<\/p>\n<p>No.265\/97 in O.S.No.455\/94 on the file of the Sub<\/p>\n<p>Court, Thalassery. The prayer in this writ petition<\/p>\n<p>is for a direction being issued to the court below<\/p>\n<p>to grant the petitioner one year&#8217;s time to pay the<\/p>\n<p>entire balance amount in the execution petition.<\/p>\n<p>It  is  submitted  that  the  amount  due  to   the<\/p>\n<p>respondents\/decree holders will be about Rupees Two<\/p>\n<p>lakhs.\n<\/p>\n<p>    2.  Now, the property has been brought up for<\/p>\n<p>sale on the execution side.   The grievance of the<\/p>\n<p>petitioner is that what is brought to sale is the<\/p>\n<p>property which is worth crores.  It has to be borne<\/p>\n<p>in mind that the execution petition is of the year<\/p>\n<p>1997 and the decree that is sought to be executed<\/p>\n<p>is one passed in a suit filed as early as in 1994<\/p>\n<p>and the petitioner\/sixth judgment debtor has no<\/p>\n<p>case that he is penniless.  What is attempted to be<\/p>\n<p><span class=\"hidden_text\">WPC 2519\/09               2<\/span><\/p>\n<p>brought to sale is the right of the petitioner over<\/p>\n<p>the building constructed by him in relation to<\/p>\n<p>which he has claimed benefit under Section 106 of<\/p>\n<p>the Kerala Land Reforms Act and the decree is<\/p>\n<p>stated to be for arrears of rent.
