DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Learned APP, waives service of rule on behalf of respondent-State.\n<\/p>\n<p>\tThis<br \/>\napplication is preferred by the applicant-convict through his wife<br \/>\nfor temporary bail on the ground that son aged around 3 years Yasraj<br \/>\nSindha is admitted for febrile convulsion with meningitis and, for<br \/>\nwhich, presence of the applicant for arranging finance is necessary.<br \/>\nIt is submitted that no other elderly member is their in the family<br \/>\nexcept the wife of the applicant-convict to take care of their son.\n<\/p>\n<p>\tConsidering<br \/>\nthe certificate dated 27.7.2011 issued by In-charge Medical Officer<br \/>\nof Shaishav Nursing Home, Panigate, Baroda, about ailment of the son<br \/>\nof the applicant, I am inclined to grant 15 days of temporary bail<br \/>\nfrom the date of his release on furnishing a personal bond of<br \/>\nRs.2,000\/- to the satisfaction of the jail authority with an<br \/>\nadditional condition that applicant shall mark his presence once in a<br \/>\nweek at Vaghodiya Police Station.  On completion of the temporary<br \/>\nperiod, the applicant shall report to the jail authority in time.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the above extent.\n<\/p>\n<p>\tDirect<br \/>\nservice today is permitted.\n<\/p>\n<p>[ANANT<br \/>\nS.
