Application Nos. 51 of 2009 as well as 63 of<br \/>\n2009, on the grounds set out in the memo.\n<\/p>\n<p>2.\tLearned<br \/>\nSpecial Public Prosecutor Mr.J.M.Panchal appearing for the State and<br \/>\nlearned Sr.Counsel Mr.Menon with learned advocate Mr. Ajaykumar<br \/>\nChokshi for Special Investigation Team (&#8216;SIT&#8217; for short) have<br \/>\nsubmitted that the learned Sessions Judge has failed to appreciate<br \/>\nthat the opponents are involved in the heinous crime and therefore,<br \/>\nconsidering this aspect and the statements of witnesses which have<br \/>\nbeen discussed in detail, the order passed by the learned Sessions<br \/>\nCourt is misconceived.  Learned Special Public Prosecutor Mr.Panchal<br \/>\nas well as learned Sr.Counsel Mr.Menon submitted that at the stage of<br \/>\napplication for bail, such a detailed appreciation of evidence is not<br \/>\nnecessary and, therefore, the learned Judge has committed an error in<br \/>\nentering into the arena of appreciation of evidence and credibility<br \/>\nof the witnesses etc.  Therefore, it was submitted that if these<br \/>\naspects are considered, the present application may be allowed and<br \/>\nthe order may be quashed and set aside.  Learned advocate Mr.Vijay<br \/>\nPatel, appearing for the original accused has, however, stated that,<br \/>\nthe trial has not only commenced but is on the verge of completion,<br \/>\nwhich is not disputed by the other side.  It has also been stated<br \/>\nthat out of 105 witnesses, about 10 to 15 witnesses  are now required<br \/>\nto be examined.  Mr.Patel has also submitted that the respondents<br \/>\naccused have co-operated  during the trial and the present<br \/>\napplication for cancellation of bail after 6 years   of the incident<br \/>\nis not proper.  It has also been submitted that the present<br \/>\napplication for cancellation of bail may not entertained particularly<br \/>\nreferring to the details stated in the impugned order that if there<br \/>\nis any apprehension, such application could have been filed at the<br \/>\ninstance of NGO or others. It is further submitted that after the<br \/>\narrest and release of the accused, they have not indulged in to any<br \/>\nactivity and they are regularly attending the Courts.  There are no<br \/>\ncomplaints of abuse or any misuse of liberty. It has also been<br \/>\nsubmitted that the applicant &#8211; accused were shown to be<br \/>\ninvolved in the further statement recorded subsequently. Therefore,<br \/>\nit was submitted that the cancellation of bail on the basis of a<br \/>\nstatement recorded subsequently without any complaint or abuse or<br \/>\nmisuse of liberty, may not be entertained.\n<\/p>\n<p>3.\tIn<br \/>\nview of the rival submissions, it is required to be considered<br \/>\nwhether present application can be entertained or not. It is well<br \/>\naccepted by catena of judicial pronouncements including the<br \/>\nobservation of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/234105\/\">Vaman Narain<br \/>\nGhiya v. State of Rajasthan,<\/a> reported in AIR 2009 SC 1362 that at<br \/>\nthe stage of considering the bail application, the Court is not<br \/>\nrequired to appreciate and scrutinize the evidence in detail and only<br \/>\nprima facie case is required to be considered.  Therefore, as<br \/>\nsubmitted by learned Special Public Prosecutor Mr.Panchal, the<br \/>\nlearned Judge has entered into the arena of appreciation and scrutiny<br \/>\nof evidence, which would not be required and therefore without any<br \/>\nfurther elaboration, it would be suffice to consider the present<br \/>\napplication for cancellation of bail on the well accepted principle<br \/>\nregarding cancellation of bail.  Admittedly, after 6 years of the<br \/>\nincident and when the trial is almost likely to be over for which<br \/>\nthere is no dispute, the bail already granted cannot be cancelled.<br \/>\nAdmittedly, there is no complaint regarding abuse or misuse of<br \/>\nliberty.\n<\/p>\n<p>4.\tTherefore,<br \/>\nconsidering the aforesaid aspect only, without going into further<br \/>\ndetails and also appreciation of evidence, this Court is of the<br \/>\nopinion that the present application cannot be entertained and<br \/>\ndeserves to be rejected and accordingly, it stands rejected.
