HEMA, J.\n\n                 ---------------------------------------------------\n                          B.A. No. 3098 of 2010\n                 ---------------------------------------------------\n                  Dated this 31st day of May, 2010.\n\n\n                                    ORDER\n<\/pre>\n<p>      Petition for bail.\n<\/p>\n<p>       2. The alleged offence is under Section 376 of IPC. According<\/p>\n<p>to the prosecution, petitioner committed rape on his sister since<\/p>\n<p>the age of 13 years onwards. She also was impregnated and it<\/p>\n<p>was aborted by the brother, posing himself to be the husband for<\/p>\n<p>the hospital records. Thereafter, proposal came for the girl after a<\/p>\n<p>few years while petitioner showed medical records to them and the<\/p>\n<p>marriage proposal fistled out.           Hence, de facto complainant was<\/p>\n<p>forced to file a complaint.\n<\/p>\n<p>       Learned counsel for petitioner submitted that petitioner&#8217;s<\/p>\n<p>mother attempted to sell           ancestral property and the petitioner<\/p>\n<p>resisted the same and therefore a false complaint is filed by his<\/p>\n<p>sister.\n<\/p>\n<p>      This petition is opposed.                  Learned Public Prosecutor<\/p>\n<p>submitted that in the light of the materials in the case diary this is<\/p>\n<p>not a fit case to grant bail to petitioner.<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>      On hearing both sides and considering the serious nature of<\/p>\n<p>the allegations and the materials     from the case diary, I am least<\/p>\n<p>inclined to grant bail to petitioner, even though investigation is<\/p>\n<p>over and charge sheet is laid, it is submitted. Petitioner may move<\/p>\n<p>appropriate court for early disposal of the case.<\/p>\n<p>      This petition is dismissed.\n<\/p>\n<\/p>\n<p>                                          K.
