Asha Jain Madan,<br \/>\nMrs.Rani chhabra, Advs. with  him for the Respondent.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\nThe following Order of the Court was delivered:<br \/>\nKrishi Utpadan Mandi Samiti Bulandshahr etc.<br \/>\nV.\n<\/p>\n<p>Ganga Sahai &amp; Ors. etc.<br \/>\n\t\t\t    With<br \/>\n\t\tCIVIL APPEAL NO 9841 OF 1996<br \/>\n\t   (Arising out of SLP (C) No. 14160\/87)<br \/>\n\t\t\t O R D E R<br \/>\n     Substitution allowed.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     We have  heard counsel  for the  parties.\tNotification<br \/>\nunder Section  4(1) of\tthe Land  Acquisition Act,  1894 was<br \/>\npublished on May 25, 1976 acquiring the land in question for<br \/>\nthe purpose  of establishing  the agricultural\tmarket yard.<br \/>\nThe award  under Section 11 was made by the Collector on May<br \/>\n10, 1977.  On reference the Additional District Judge by his<br \/>\naward and  decree dated\t September  15,\t 1979  enhanced\t the<br \/>\ncompensation to\t Rs.10\/- per  sq. yd.  with solatium at\t 15%<br \/>\nand interest  at 6%.  On appeal, the High Court enhanced the<br \/>\ncompensation to\t Rs.15\/- per  sq. yd.  The High\t Court\talso<br \/>\nenhanced solatium and interest under the Amendment Act 68 of<br \/>\n1984 as well as the additional amount under Section 23(1-A).<br \/>\nThus these appeals by special leave.\n<\/p>\n<p>     It is  not necessary  to dilate  upon all the facts but<br \/>\nthe point  that another\t Division  Bench  had  followed\t the<br \/>\nearlier order  and awarded  common market  value to all tile<br \/>\nlands. Though  Shri O.P.  Rana, learned\t senior counsel,  is<br \/>\nright that  in the  first case\tthe Division  Bench had\t not<br \/>\ngiven cogent reason For enhancement of the market value from<br \/>\nRs.10\/- to  Rs.15\/sq. yd.,  we find that the reference Court<br \/>\nhad given  various reasons for confining to the market value<br \/>\nat Rs.10\/-  per sq.  yd. Though\t the basis  under  with\t the<br \/>\nmarket value  was determined by the High Court was not after<br \/>\nproper appreciation  of evidence,  the principle involved in<br \/>\ndetermining the compensation cannot be faulted Though we are<br \/>\nnot satisfied  with t  e reasoning of the Division Bench, we<br \/>\nare not\t inclined to  interfere with  the enhancement of the<br \/>\ncompensation to\t Rs: 15\/- per sq. yd. However, the claimants<br \/>\nare not\t entitled to  the enhanced solatium and interest and<br \/>\nalso the  additional amount  since the\treference Court\t had<br \/>\nmade the award and decree on September 15, 1979 that is much<br \/>\nearlier to  the introduction  of the  Amendment Act 68\/1984.<br \/>\nTherefore, the\tenhancement of\t30% solatium, interest at 9%<br \/>\nfor one\t year from  the date  of taking\t possession and\t 15%<br \/>\nthereafter till\t date of  deposit  and\talso  of  additional<br \/>\namount under  Section 23(1-A) stands set aside. Instead, the<br \/>\nclaimants will\tbe entitled  to solatium at 15% and interest<br \/>\nat 6%  on enhanced  compensation from  the  date  of  taking<br \/>\npossession till\t date of deposit as ordered by this Court in<br \/>\nthe interim order.\n<\/p>\n<p>     The appeals are accordingly disposed of.
