Barkath Ali, JJ.\n<\/p>\n<p>           &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>                 MACA.No. 2023 of 2005 &#8211; B\n<\/p>\n<p>          &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>         Dated this the 1st day of November, 2010<br \/>\n                               Judgment<br \/>\nBasheer, J:\n<\/p>\n<p>         Legal heirs of deceased victim of a road traffic<\/p>\n<p>accident have filed this appeal impugning the award passed<\/p>\n<p>by the Motor Accidents Claims Tribunal.<\/p>\n<p>        2. The deceased was riding a two wheeler on the<\/p>\n<p>ill-fated day. It appears that his two wheeler collided<\/p>\n<p>against a lorry coming from the opposite direction. The<\/p>\n<p>Claim Petition was initially laid under Section 166 of the<\/p>\n<p>Motor Vehicles Act. But later the claim was converted as<\/p>\n<p>one under Section 163A. However no other amendments<\/p>\n<p>particularly with regard to the monthly income of the<\/p>\n<p>deceased was carried out in the Claim Petition.<\/p>\n<p>        3.   It is the case of the appellants that the deceased<\/p>\n<p>was working in a Middle East country and earning<\/p>\n<p>Rs.22,000\/- per month. But when the Claim Petition was<\/p>\n<p>converted as one under Section 163A,                           no suitable<\/p>\n<p>amendment was sought for. The Tribunal dismissed the<\/p>\n<p>Claim Petition as not maintainable since the monthly<\/p>\n<p>income of the deceased exceeded Rs.4,000\/-.<\/p>\n<p>        4. There is yet another aspect of the matter. As has<\/p>\n<p>MACA.2023\/05                  : 2 :\n<\/p>\n<p>been mentioned earlier, the accident occurred due to a head<\/p>\n<p>on collision. It is on record that the Police charge sheeted<\/p>\n<p>the driver of the lorry as well as the rider of the two<\/p>\n<p>wheeler. Pw.2 was examined on the side of the claimants<\/p>\n<p>and he spoke about the accident. However the lorry driver<\/p>\n<p>never bothered to step into the box and deny the charge of<\/p>\n<p>rash and negligent driving made against him. But still the<\/p>\n<p>Tribunal proceeded to hold that deceased rider was entirely<\/p>\n<p>responsible for the accident,    ignoring the fact that the<\/p>\n<p>Police had charge sheeted both the drivers. We are afraid<\/p>\n<p>the approach made by the Tribunal is totally unwarranted,<\/p>\n<p>especially in the absence of any contra evidence adduced by<\/p>\n<p>the lorry driver. The Tribunal has of course referred to the<\/p>\n<p>scene mahazar prepared by the Police. But that could not<\/p>\n<p>have been the be-all and end-all in such matters.<\/p>\n<p>        5. A Division Bench of this Court in Phillippose<\/p>\n<p>Cherian and anr. v. T.A.Edward Lobo &amp; anr. (1991 ACJ<\/p>\n<p>634) has observed thus:\n<\/p>\n<blockquote><p>           &#8220;..In a scene mahazar it is usual to<\/p>\n<p>           contain two types of facts.     Those<\/p>\n<p>           facts which were     observed by the<\/p>\n<p>MACA.2023\/05                   : 3 :<\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>          author with his own eyes and those<\/p>\n<p>          which he heard from others. The latter<\/p>\n<p>          category is hearsay and is hence<\/p>\n<p>          inadmissible except for certain limited<\/p>\n<p>          uses. An entry in scene mahazar which<\/p>\n<p>          relates to what the author has seen<\/p>\n<p>          with his own eyes is admissible as<\/p>\n<p>          direct evidence.&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>We have referred to the conclusion made by the Tribunal<\/p>\n<p>in order to highlight the fact that such an exercise has been<\/p>\n<p>carried out by the Tribunal in the absence of any contra<\/p>\n<p>evidence adduced by the driver and that too relying solely<\/p>\n<p>on the scene mahazar. In our view, the Tribunal ought to<\/p>\n<p>have been a little more circumspect and careful especially<\/p>\n<p>on the face of the composite charge laid by the Police<\/p>\n<p>against the two drivers. Anyway, we do not propose to<\/p>\n<p>deal with the above issue any further, in view of the order<\/p>\n<p>that we propose to pass.<\/p><\/blockquote>\n<p>      6. Having heard learned counsel for the parties and<\/p>\n<p>having perused the materials available on record, we are of<\/p>\n<p>the view that the appellants have to be given a further<\/p>\n<p>MACA.2023\/05                  : 4 :\n<\/p>\n<p>opportunity to prosecute their case appropriately. It will be<\/p>\n<p>open to the appellants to amend the pleadings, if so advised,<\/p>\n<p>in which event the respondents shall also be entitled to<\/p>\n<p>adduce further evidence, both oral and documentary.<\/p>\n<p>        7. Therefore the impugned award is set aside. The<\/p>\n<p>case is remitted to the Tribunal for fresh disposal in<\/p>\n<p>accordance with law.\n<\/p>\n<p>      Parties shall appear before the Tribunal on November<\/p>\n<p>30, 2010.\n<\/p>\n<\/p>\n<p>                                 A.K.
