Justice ANTONY DOMINIC\n\n Dated :11\/08\/2008\n\n O R D E R\n                     ANTONY DOMINIC, J\n\n    -----------------------------------------------------------\n                    W.P.(C).No.20634\/2008\n    -----------------------------------------------------------\n          Dated this the 11th     day of August, 2008\n\n\n                           JUDGMENT\n<\/pre>\n<p>     Petitioners submit that, in a property which is adjacent<\/p>\n<p>to their residential premises belonging to the respondents 7<\/p>\n<p>to 10, a structure has been completed and that in the said<\/p>\n<p>structure, the 11th respondent is proceedings to establish a<\/p>\n<p>workshop without obtaining a licence from the first<\/p>\n<p>respondent Municipality.\n<\/p>\n<p>     2. Respondents 7 to 10 and 11 submits that, a plot of<\/p>\n<p>land belonging to respondents 7 to 10 is being developed by<\/p>\n<p>the 11th respondent based on an agreement among<\/p>\n<p>themselves. It is stated that only after development work is<\/p>\n<p>completed,    will they be in a position to make application<\/p>\n<p>to the first respondent Municipality for utilization of the<\/p>\n<p>building for the purpose for which it is intended.<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20674\/08             2<\/span><\/p>\n<p>      3. It is stated that, so far they have not completed the<\/p>\n<p>structure and only thereafter         they will     make an<\/p>\n<p>application. Municipality also confirms that     no application<\/p>\n<p>for licence has been received by them.\n<\/p>\n<p>       4. If as stated by respondent No.11, they have not<\/p>\n<p>obtained any licence in respect of the premises in question,<\/p>\n<p>it is only natural that they cannot establish any workshop or<\/p>\n<p>other facility in the building in question. Now that the<\/p>\n<p>respondent No.11 submits that, they will make an<\/p>\n<p>application to the Municipality, on           completing the<\/p>\n<p>developmental works, it will be the Municipality&#8217;s duty to<\/p>\n<p>consider the application with notice to the petitioners who<\/p>\n<p>are the neighbouring respondents.\n<\/p>\n<p>      Therefore, writ petition is disposed of directing that,<\/p>\n<p>without    licence,    the   Municipality  shall  not   permit<\/p>\n<p>respondents 7 to 10 or 11 to establish any workshop or<\/p>\n<p>other establishment and that as and when an application<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20674\/08          3<\/span><\/p>\n<p>received from them or any one of them, the Municipality<\/p>\n<p>shall consider with same only with notice to the petitioners.<\/p>\n<p>                                  ANTONY DOMINIC<br \/>\n                                  JUDGE<\/p>\n<p>vi.\n<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20674\/08    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court N.A.Sheriffa vs Kalamassery Municipality on 11 August, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 20634 of 2008(F) 1.
