Heard    learned        counsel        for     the<\/p>\n<p>                            petitioner and the counsel appearing<\/p>\n<p>                            on behalf of the State.\n<\/p>\n<p>                               2.    The    petitioner          has     challenged<\/p>\n<p>                       the order dated 22.3.2004, passed by the<\/p>\n<p>                       Chief     Judicial        Magistrate,          Samastipur,<\/p>\n<p>                       in G.R. Case No. 1734 of 2000, arising<\/p>\n<p>                       out of Patory P.S. Case No. 149 of 2000.<\/p>\n<p>                               3. I do not think that this is a<\/p>\n<p>                       fit case in which the Court can decide<\/p>\n<p>                       whether the petitioner participated in<br \/>\n<span class=\"hidden_text\">                                           -2-<\/span><\/p>\n<p>                        the occurrence or not on the basis of<\/p>\n<p>                        the   materials    before    this    Court.         It<\/p>\n<p>                        would require a full fledged trial.<\/p>\n<p>                              4.
