NAUSHAD KHAN\n                                            Versus\n                                 THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2.   24.02.2011.               Heard       learned     counsels      for        the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p>                               The    petitioner      is    apprehending        his<\/p>\n<p>                   arrest      in      a     complaint      case     in        which<\/p>\n<p>                   cognizance has been taken under Section 498A<\/p>\n<p>                   of the I.P.C. and Section \u00be of the D. P.<\/p>\n<p>                   Act.\n<\/p>\n<p>                               It appears from Annexure-2 that in<\/p>\n<p>                   Matrimonial Case No. 46 of 2009 filed by the<\/p>\n<p>                   petitoner, an ex-parte decree of restitution<\/p>\n<p>                   of conjugal rights has been passed.<\/p>\n<p>                               Considering the aforesaid facts, let<\/p>\n<p>                   the petitioner above named be released on<\/p>\n<p>                   bail   in    the    event    of    arrest    or   surrender<\/p>\n<p>                   before      the    learned       court   below    within       a<\/p>\n<p>                   period      of     twelve     weeks      from     today       in<\/p>\n<p>                   connection with Complaint Case No. 109 of<\/p>\n<p>                   2008 on furnishing bail bond of Rs. 10,000\/-<\/p>\n<p>                   (Ten Thousand) with two sureties of the like<\/p>\n<p>                   amount      each     to    the    satisfaction         of     the<\/p>\n<p>                   learned S.D.J.M., Samastipur, subject to the<\/p>\n<p>                   conditions as laid down under Section 438(2)<\/p>\n<p>                   of Cr. P. C.\n<\/p>\n<p><span class=\"hidden_text\">                          2<\/span><\/p>\n<p>                  If   the   complainant    expresses      her<\/p>\n<p>        willingness to resume the conjugal life then<\/p>\n<p>        the learned court below will issue notice to<\/p>\n<p>        the   petitioner     who    will   take    back    the<\/p>\n<p>        complainant    to    her   matrimonial    house    and<\/p>\n<p>        keep the complainant with full dignity and<\/p>\n<p>        honour.\n<\/p>\n<p>\nU.
