Advocate for\nrespondent Nos. 1 and 2.<\/pre>\n<p>     Shri V.S. Shroti, learned Senior Counsel with Shri<br \/>\nVikram Johri, learned Counsel for respondent No. 3.\n<\/p>\n<p>     Shri G.S. Baghel, learned counsel for intervener.<br \/>\n     Challenge put-forth in the present petition is to an<br \/>\norder dated 23.6.2008 whereby respondent No. 4 was<br \/>\nappointed as Notary for Tahsil Tamia.\n<\/p>\n<p>     When the matter is taken up today, it is submitted by<br \/>\nlearned counsel for the petitioner that the subject matter of<br \/>\nthe present petition, i.e., order dated 23.6.2008 has already<br \/>\nbeen quashed in W.P. No. 9046\/2008 &#8211; <a href=\"\/doc\/118682575\/\">Vijay Kumar Gupta<br \/>\nv. State of M.P. and others<\/a>. It is urged that in the light of<br \/>\nthe order passed in W.P. No. 9046\/2008 present petition<br \/>\ndeserves to be allowed.\n<\/p>\n<p>     In Vijay Kumar Gupta (supra) while placing reliance<br \/>\non judgment rendered by Division Bench in Rajendra<br \/>\nKumar Choudha and others v. Ayaz Ahmad Khan and<br \/>\nothers &#8211; W.A. No. 167\/2009 decided on 19.2.2010, their<br \/>\nlordships were pleased to observe:\n<\/p>\n<blockquote><p>     &#8220;16. In the instant matters what District Judge has<br \/>\n     done that he has invited the objections from the Bar<br \/>\n     Association, no objection was received and thereafter<br \/>\n     has forwarded the list of all the persons arranged in<br \/>\n     order of seniority to the State Government. The<br \/>\n     District Judge has totally failed to act as per the<br \/>\n     mandate of Rule 7(3) of the Rules. It was incumbent<br \/>\n     upon the District Judge to send the names arranged in<br \/>\n     order of suitability of the incumbents whom he has<br \/>\n     considered to be appropriate having due regard to<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>knowledge and experience, extent of practice and<br \/>\nfitness, which has not been done in the instant case.\n<\/p><\/blockquote>\n<p>Thus the learned Single Judge is justified in quashing<br \/>\nthe consequential action taken on the basis of<br \/>\nviolation of Rule 7(3) of the Rules.\n<\/p>\n<p>17. Shri V.S.Shroti, learned Sr. Counsel has submitted<br \/>\nthat the District Judge should be permitted to conduct<br \/>\noral interview of the incumbents. We do not go to that<br \/>\nextent as oral interview is contemplated in the next stage<br \/>\nafter recommendation is made by the competent authority<br \/>\nto the State Government, however, in order to ascertain<br \/>\nthe suitability, it is open to him to make such inquiry as<br \/>\nhe deems fit. He is free to call the candidates to find out<br \/>\nthe suitability as per Rule 7 of the Rules but simply calling<br \/>\na candidate to elicit an information would not amount to<br \/>\ninterviewing him, it would only be step in aid in order to<br \/>\nform an opinion under Rule 7(3) of the Rules. When the<br \/>\ncompetent authority applies the mind to the requirement<br \/>\nof Rule 7(3), which may be applicable in the case, it<br \/>\nshould appear from the noting of the file that the<br \/>\ncompetent authority has made the recommendation after<br \/>\ndue compliance of Rule 7 of the Rules. He is not supposed<br \/>\nto act in a mechanical manner. The appointment of<br \/>\nnotary, as already mentioned, is an important job and<br \/>\nnames of only honest persons with integrity should be<br \/>\nrecommended by the District Judge, not the names of all<br \/>\nthe incumbents in order of their seniority or category wise<br \/>\nas done in the instant case. The eligibility of an incumbent<br \/>\nis a different aspect than assessing the suitability.<br \/>\nArranging the names in order of seniority cannot be said<br \/>\nto be as per suitability. A person&#8217;s suitability has to be<br \/>\nadjudged on the basis of objective criteria as laid down in<br \/>\nthe Rules. It has been considered, must reflect from the<br \/>\nfile. The competent authority cannot shirk from it&#8217;s<br \/>\nsignificant responsibility enjoined upon him under the<br \/>\nRules to ensure that incompetent and dishonest<br \/>\nincumbents are not appointed as notary on political basis<br \/>\nand eliminated at grass root level. Recommendation of the<br \/>\nDistrict Judge serves the purpose of weeding out such<br \/>\nelements from the zone of consideration who are not<br \/>\notherwise fit and suitable as per the requirements of the<br \/>\nRules. The District and Session Judges are expected to<br \/>\nrise to the occasion, select the persons for recommending<br \/>\n<span class=\"hidden_text\">                                                3<\/span><\/p>\n<p>                      the names as per the criteria which has been laid down<br \/>\n                      under the Rules and not to oblige every incumbent by<br \/>\n                      sending the entire list to the State Government which<br \/>\n                      amounts not only shirking from duty but tantamounts to<br \/>\n                      flagrant violation of the rules at the end of the competent<br \/>\n                      authority which cannot be tolerated even for a moment.<br \/>\n                      Thus District and Session Judges to be careful in future in<br \/>\n                      making the recommendation. It has to be ensured that<br \/>\n                      only the names of suitable persons be recommended as<br \/>\n                      per requirements of Rules.&#8221;\n<\/p>\n<p>                      On the basis of the aforesaid verdict appointment of<br \/>\n                 respondent No. 4 being contrary to the provisions contained<br \/>\n                 under Rule 7 Notaries Rules, 1956 was quashed.\n<\/p>\n<p>                      Since the appointment of respondent No. 4 has<br \/>\n                 already been quashed in W.P. No. 9046\/2008 no further<br \/>\n                 order is required in the present petition and the order<br \/>\n                 passed in W.P.
