Whether the judgment should be reported in the Digest?<\/p>\n<p>Present:     Shri Parminder Singh, Advocate, for the petitioner.<\/p>\n<p>HEMANT GUPTA, J (Oral).\n<\/p>\n<p>             The challenge in the present revision petition is to the order<\/p>\n<p>passed by the learned Motor Accident Claims Tribunal, on 18.3.2009,<\/p>\n<p>whereby an application filed by the petitioner for release of the amount of<\/p>\n<p>compensation was declined.\n<\/p>\n<p>             It is the case of the petitioner that he has received injuries in a<\/p>\n<p>motor vehicular accident. The Tribunal has awarded a sum of Rs.2 lacs as<\/p>\n<p>compensation along with interest. A sum of Rs.1 lac has already been<\/p>\n<p>disbursed to the petitioner. The balance sum of Rs.1,39,250\/-, inclusive of<\/p>\n<p>interest, is claimed by the petitioner. It is asserted by the petitioner that he<\/p>\n<p>was 35 years of age when he sought compensation and that money is<\/p>\n<p>required for restarting his business.\n<\/p>\n<p>             Keeping in view the fact that the petitioner is a grown up adult<br \/>\n Civil Revision No. 2030 of 2009                           (2)<\/p>\n<p>and engaged in business, the deposit of the amount in a fixed deposit, will<\/p>\n<p>not be of optimum utilisation. If the amount is released to the petitioner, he<\/p>\n<p>can utilise the same in a constructive way by utilising the same in his<\/p>\n<p>business, rather than to keep the same in the fixed deposit.<\/p>\n<p>             In view of the above, the impugned order dated 18.3.2009 is set<\/p>\n<p>aside.
