ORAL JUDGEMENT (Per : MR.JUSTICE D.K.TRIVEDI)\n<\/p><\/blockquote>\n
1.Rule. Mr.       L.R.Pujari, learned APP waives
\nservice of Rule on behalf of respondents.   By consent,
\nthe rule is fixed forthwith.\n<\/p>\n
2.This application is filed by the        applicant
\nconvict jail praying for temporary bail for a period of 3
\nweeks   on   the   ground that the applicant’s nephew
\nRanjitsinh’s marraige is fixed on 10.5.2003 and the
\nmarriages of his sister’s two sons, namely, Dilipsingh
\nand Nathuji, are fixed on 20.5.2003, and the presence of
\nthe applicant is required at the time of their marriage.
\nIt is also the case of the applicant that the applicant
\nhad enjoyed one time temporary bail and one time furlough
\nleave and had surrendered to the Jail Authority in time.
\nThe applicant has also annexed the invitation cards
\nshowing the marriage of Dilipsingh and Nathuji, etc, as
\nobserved earlier. The Police opinion produced by Mr.
\nPujari for our perusal shows that the police opinion is
\nagainst the prisoner, and according to the Police, if the
\napplicant – convict is released, there will be a breach
\nof peace.    The jail statement shows that the applicant
\nwas convicted by the learned Additional Sessions Judge,
\nAhmedabad, for the offence under Section 302 of the IPC
\non 20.7.2000 and has ordered to suffer R.I.    for life.
\nHe is in jail for about more than 4 years including the
\nperiod of remission earned by him. Twice he was released
\non temporary bail and once furlough leave and all the
\noccasions, he surrendered to the Jail Authorities in
\ntime. In spite of this, the police opinion shows that if
\nthe applicant accused is released on temporary bail,
\nthere is likelihood of breach of peace. In our view,
\nsuch opinion is given mechanically without verifying the
\nfact that earlier the accused was released twice on
\ntemporary bail and once on furlough leave and no untoward
\nincident had occurred and further that all the times the
\naccused had surrendered to the Jail Authority in time.
\nAccordingly, we are inclined to release the applicant
\nconvict on temporary bail and the Jail Authority is
\ndirected to release the applicant – accused on temporary
\nbail from 8.5.2003 on furnishing cash deposit of Rs.
\n2,000\/- (Rupees two thousand only) with        the   Jail
\nAuthority on usual terms and conditions and he shall
\nsurrender to the Jail Authority on 12.05.2003, and
\nthereafter on his surrender, again the applicant is
\nordered to be released on temporary bail from 18.5.2003
\nand he is directed to surrender to the Jail Authority on
\n 21.5.2003 on the same terms and conditions.           The
\napplicant is further directed to surrender to the Jail
\nAuthority on expiry of both the period of temporary bail.
\nRule is accordingly made absolute in the above terms.
