The matter came up<br \/>\nfor consideration before this Court on 05.05.2010 when notice was<br \/>\nissued returnable on 16.06.2010.  The relevant part of the order<br \/>\nreads as under:-\n<\/p>\n<p> &#8230;..  On<br \/>\ncondition that the difference of the amount shall be deposited before<br \/>\nthe the Commissioner, Workmen&#8217;s Compensation, Labour Court, Jamnagar<br \/>\nand the receipt thereof is produced in the registry of this Court,<br \/>\nthe disbursement shall not be made, until then&#8230;..\n<\/p>\n<p>2.\tThe matter<br \/>\nthen appeared on 08.07.2010 and it was adjourned to 23.07.2010, at<br \/>\nthe request made by learned Advocate Mr.Kariel to enable him to<br \/>\nexplore possibility of putting all controversies to an end amicably.<br \/>\n On 23.07.2010, learned Advocate Mr.Kariel was granted time as he had<br \/>\nnot received any report from his client about any progress having<br \/>\nbeen made towards amicable settlement.  The First Appeal was admitted<br \/>\nand on the same day, Rule was issued in this Civil Application<br \/>\nreturnable today, i.e. 05.08.2010.\n<\/p>\n<p>3.\tLearned<br \/>\nAdvocate Mr.Patel for the applicant invited attention of the Court to<br \/>\nthe fact that the respondent is adamant on not vacating the quarter<br \/>\noccupied by him.  He also submitted that looking to the location of<br \/>\nthe quarter, the respondent is in no mood to vacate the same.  He<br \/>\nrequested that it will be in the interest of justice if the<br \/>\ndisbursement of the amount deposited is made conditional on vacating<br \/>\nof the quarters and recovery of the legitimate dues from the<br \/>\napplicant, to which he has no objection and he has taken instructions<br \/>\nfrom the appellant in this regard.\n<\/p>\n<p>3.1\tLearned<br \/>\nAdvocate for the appellant also submitted that if the rent is charged<br \/>\nat concessional rate, the amount levied by the appellant comes to<br \/>\nRs.49,000\/-.  If the normal rent is charged, it comes to Rs.83,000\/-<br \/>\nand if penal interest is charged, the amount comes to Rs.7 lacs.\n<\/p>\n<p>4.\tIn view of<br \/>\nthe aforesaid discussion, the stay granted by this Court against<br \/>\ndisbursement on 05.05.2010 is confirmed.  The Workman Compensation<br \/>\nCommissioner is directed to deposit this amount in a Fixed Deposit,<br \/>\ninitially for a period of 3 years with any nationalized Bank with<br \/>\ncumulative effect, subject to periodical renewal till the final<br \/>\ndisposal of the First Appeal.  Rule is made absolute.
