Sri.Joby Cyriac, the<\/p>\n<p>learned Standing Counsel takes notice for the second respondent.<\/p>\n<p>     2. Heard both sides. Under challenge in this writ petition<\/p>\n<p>under Article 226 is Ext.P3 judgment of the land acquisition<\/p>\n<p>reference court declining to answer the reference on the ground<\/p>\n<p>that the reference in as much as the same has been made not on<\/p>\n<p>the basis of a valid application for      reference.  The learned<\/p>\n<p>Subordinate Judge has referred to and relied on the judgment of<\/p>\n<p>the Division Bench of this court in <a href=\"\/doc\/533947\/\">Pathootty v. District<\/p>\n<p>Collector<\/a> (2004 (3) KLT 348) for holding that the reference<\/p>\n<p>(Ext.P2) made by the Land acquisition Officer on the basis of<\/p>\n<p>Ext.P1 statement filed by the petitioner is not a valid reference.<\/p>\n<p>It appears to me that a subsequent judgment of another Division<\/p>\n<p>Bench of this court, authored by the same senior judge who<\/p>\n<p><span class=\"hidden_text\">WPC.No.25005\/2008                 2<\/span><\/p>\n<p>authored the judgment in Pathootty&#8217;s case (supra), in <a href=\"\/doc\/1974324\/\">Antony<\/p>\n<p>v. State of Kerala<\/a> (2005 (1) KLT 583) is a more apposite<\/p>\n<p>precedent governing the fact situation which obtains in this case.<\/p>\n<p>It appears to me that if Antony&#8217;s case was cited before her, the<\/p>\n<p>learned sub judge would have become inclined to take different<\/p>\n<p>view .\n<\/p>\n<p>     I dispose of this writ petition without deciding the merits of<\/p>\n<p>the grounds raised permitting the petitioner to seek review of<\/p>\n<p>Ext.P3 judgment and Ext.P4 decree on the basis of the judgment<\/p>\n<p>in Antony&#8217;s case.
