Nanavaty, learned APP waives service of notice on behalf of<br \/>\n\trespondent State. With the consent of the parties rule is fixed<br \/>\n\tforthwith.\n<\/p>\n<p>The<br \/>\n\tapplicants, who have been apprehended their arrested in connection<br \/>\n\twith I.CR. No. 60 of 2010 with Bharuch City &#8220;A&#8221; Division<br \/>\n\tPolice Station at Bharuch have moved this application under section<br \/>\n\t438 of Cr.P.C. for seeking   anticipatory bail in the event of their<br \/>\n\tlikely arrest in respect of aforesaid complaint for the offences<br \/>\n\tpunishable under sections 376(G) read with Section 114 of the IPC.\n<\/p>\n<p>The<br \/>\n\taccused moved the application being Criminal Misc. Application No.<br \/>\n\t320 of 2010 before the concerned Sessions Court, which came to be<br \/>\n\trejected on 11.5.2010.\n<\/p>\n<p>The<br \/>\n\tcase of the original complainant in FIR is with regard to accused<br \/>\n\tno. 1 committing rape and the role attributed to present applicants<br \/>\n\tis that of abating the accused no. 1 in committing the crime. The<br \/>\n\tCourt has perused the FIR and the order impugned passed by the<br \/>\n\tSessions Court declining exercise of granting anticipatory bail to<br \/>\n\tthe accused and on close perusal of FIR and development of incident<br \/>\n\tmentioned thereunder, couple with the role attributed to present<br \/>\n\tapplicants, the Court is of the view that the role of present<br \/>\n\tapplicants cannot be said to be acceptable in accordance with social<br \/>\n\tnorms. However, when the allegations of committing offence under<br \/>\n\tSection 376 and abatement thereof is alleged, the Court need not to<br \/>\n\tswede by which may not be in accordance with social norms. The<br \/>\n\tallegations are to be viewed from the offence alleged in the FIR The<br \/>\n\tnarration of the incident in the FIR has persuaded this Court that<br \/>\n\tpresent applicants deserve to be enlarged on bail in the event of<br \/>\n\ttheir arrested for the following reasons :\n<\/p>\n<p>The<br \/>\n\trole attributed to the present applicants in the FIR itself deserve<br \/>\n\tto be taken into consideration for granting this application.\n<\/p>\n<p>The<br \/>\n\tcounsel for the applicants has assured this Court that the<br \/>\n\tapplicants would cooperate in the investigation in case this<br \/>\n\tapplication is granted.\n<\/p>\n<p>This<br \/>\n\tapplication is therefore deserves to be allowed and is accordingly<br \/>\n\tallowed on the following conditions as under:\n<\/p>\n<p>\tThat<br \/>\nin the event of arrest of the applicants in connection with CR. No.<br \/>\nI. 60 of 2010  registered at Bharuch City &#8220;A&#8221; Division<br \/>\nPolice Station at Bharuch, they shall be released on anticipatory<br \/>\nbail in respect of the offences alleged against them in this<br \/>\napplication, on their executing a bond of Rs.5,000=00 (Rs. Five<br \/>\nthousand only) each with one surety of the like amount, by the<br \/>\nconcerned Police Officer and on conditions that they shall;\n<\/p>\n<p>(a)<br \/>\nremain present before the Trial Court \tregularly as and \twhen<br \/>\ndirected on the dates \tfixed;\n<\/p>\n<p>(b)<br \/>\nappear before the concerned Police Station, \ton 28.6.2010 \tbetween<br \/>\n10.00 am to 12.00 \tNoon.\n<\/p>\n<p>(c)<br \/>\nmake themselves available for interrogation \tby the police \tofficer<br \/>\nwhenever and \twherever required;\n<\/p>\n<p>(d)<br \/>\nnot directly or indirectly make any \tinducement, threat or promise to<br \/>\nany person \tacquainted with the fact of the case so as \tto dissuade<br \/>\nthem from disclosing such facts \tto the Court or to any police<br \/>\noffice;\n<\/p>\n<p>(e)<br \/>\n\tnot to obstruct or hamper the police \tinvestigation and \tnot to play<br \/>\n\tmischief with \tthe evidence collected or \tyet to be \tcollected by<br \/>\n\tthe police;\n<\/p>\n<p>(f)<br \/>\n\tat the time of execution of bond, furnish \tthe address \tto the<br \/>\n\tInvestigating Officer \tand the Court concerned \tand shall not<br \/>\n\t\tchange their residence till the final \tdisposal of the case or till<br \/>\n\tfurther orders;\n<\/p>\n<p>(g)<br \/>\n\tnot leave Gujarat State without the prior \tpermission of \tthe Court<br \/>\n\tand, if having \tpassport, shall deposit the same before the \tTrial<br \/>\n\tCourt;within a week.\n<\/p>\n<p>It<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it proper and just, and the concerned<br \/>\n\tMagistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the applicant is arrested at anytime within<br \/>\n\t90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of their<br \/>\n\tarrest. Thereafter, it will be open to the applicants to make a<br \/>\n\tfresh application for being enlarged on bail in usual course which<br \/>\n\twhen it comes before the competent Court, will be disposed of in<br \/>\n\taccordance with law, having regard to all the attending<br \/>\n\tcircumstances and the materials available at the relevant time,<br \/>\n\tun-influenced by the fact that anticipatory bail was granted.\n<\/p>\n<p>\tRule<br \/>\n\tmade absolute.
