Raval for respondent NO.1. Learned AGP Ms.Jirga Jhaveri<br \/>\n\tis appearing for respondent NO.2. Notice has been served to<br \/>\n\trespondent no.3 by affixing but no appearance has been filed by<br \/>\n\trespondent no.3. Therefore, this court passed following order on 3rd<br \/>\n\tSeptember, 2010 :\n<\/p>\n<p> 1.\tHeard<br \/>\n\tlearned advocate Ms.P.J.Joshi appearing on behalf of petitioner and<br \/>\n\tlearned advocate Mr.Hemant B. Raval appearing on behalf of<br \/>\n\trespondent No.1. Though notice is served to respondent No.2 &#8211;<br \/>\n\tDistrict Education Officer, Ahmedabad, no appearance is filed on<br \/>\n\tbehalf of respondent No.2. Though fresh notice is issued to<br \/>\n\trespondent No.3   Kamlesh<br \/>\n\tDevandas Lakhani by this Court in pursuance to order dated<br \/>\n\t12.08.2010, it is not received back. Therefore, the matter is<br \/>\n\tadjourned to 14.09.2010. Let Registry may verify whether notice<br \/>\n\tissued by this Court through RPAD is served to respondent No.3 or<br \/>\n\tnot.\n<\/p>\n<p>2.\tMeanwhile,<br \/>\n\tit is directed to respondent No.1   Principal of Kanjani Gurnomal<br \/>\n\tKhialdas Primary English School, Opp.Post Office, Bunglow Area,<br \/>\n\tKubernagar, Ahmedabad   382 340 to issue provisional school<br \/>\n\tleaving certificate immediately on or before 07.09.2010 in favour of<br \/>\n\tthe daughter of petitioner, subject to the objection of respondent<br \/>\n\tNo.3.\n<\/p>\n<p>3.\tThis<br \/>\n\torder is passed by this Court considering the future of student and<br \/>\n\twithout prejudice to the rights and contention of the other side, so<br \/>\n\tthat, it may not come in the way of examination of student which<br \/>\n\twill be commence from 13.09.2010.\n<\/p>\n<p>\tDirect<br \/>\n\tservice today is permitted.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid order passed by this court, Principal of<br \/>\n\trespondent NO.1 Kanjani Gurnomal Khialdas Primary English School has<br \/>\n\tissued provisional School Leaving Certificate in favour of present<br \/>\n\tpetitioner which has been received by petitioner on 7th<br \/>\n\tSeptember, 2010 and, therefore, immediate requirement as well as<br \/>\n\tpurpose has been served for which agony, present petition is filed<br \/>\n\tby petitioner. Therefore, according to my opinion, at this stage,<br \/>\n\tthis petition is required to be disposed of with a direction to<br \/>\n\trespondent no.1 to communicate to respondent no.3 by Registered AD<br \/>\n\tletter that in view of order of this court dated 3.9.2010,<br \/>\n\trespondent no.1 school authority has issued provisional School<br \/>\n\tLeaving Certificate in favour of petitioner.\n<\/p>\n<p>In<br \/>\n\tlight of these observations and directions, this petition is<br \/>\n\tdisposed of at this stage without expressing any opinion on merits<br \/>\n\tand with a liberty in favour of petitioner to file appropriate<br \/>\n\tproceedings before appropriate forum in accordance with law in case<br \/>\n\tof any difficulty. Notice is discharged.
