However, any<br \/>\napplication seeking condonation of delay caused in filing the appeal<br \/>\nwas not filed. Since, the appellate authority, in absence of any<br \/>\napplication seeking condonation of delay and justifying the delay<br \/>\ncaused in filing the appeal and making out sufficient cause for<br \/>\ncondoning the delay, can not condone the delay, the appellate<br \/>\nauthority passed the order which is impugned in the present petition.\n<\/p>\n<p>3.\tBy<br \/>\nthe impugned order the appellate authority has disposed of the appeal<br \/>\nas barred by limitation. Since, undisputedly, there was no<br \/>\napplication seeking condonation of delay, the aforesaid order came to<br \/>\nbe passed.\n<\/p>\n<p>3.\tTherefore,<br \/>\nafter arguing the petition to some extent, learned advocate for the<br \/>\npetitioner has submitted that the petitioner would approach the<br \/>\nauthority with appropriate application seeking condonation of delay<br \/>\nand requesting the authority to pass appropriate order thereon, more<br \/>\nparticularly, in view of the fact that appeal was barred by only<br \/>\nthree days.\n<\/p>\n<p>4.\tHaving<br \/>\nregard to the submissions made by learned advocate, petition is<br \/>\ndisposed of at this stage since the petitioner intends to approach<br \/>\nthe appellate authority with appropriate application seeking<br \/>\ncondonation of delay in filing the appeal. If and when such<br \/>\napplication is preferred, the appellate authority shall consider the<br \/>\nsame in accordance with law and without being influenced by the order<br \/>\nimpugned in present petition or even this order.
