Justice R.BASANT\n\n Dated :03\/11\/2008\n\n O R D E R\n                            V.GIRI,J.\n                      -------------------------\n                  W.P ( C) No.16033 of 2008\n                     --------------------------\n            Dated this the 25th September, 2008\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioner seeks a direction to the respondents to<\/p>\n<p>disburse the contract amount due to him in relation to a<\/p>\n<p>contract which he had executed with the Electricity Board<\/p>\n<p>involving construction of the approach road to Anathodu<\/p>\n<p>Dam.    Electricity Board has filed a counter affidavit<\/p>\n<p>contending that there is a higher amount due from the<\/p>\n<p>petitioner for the the loss sustained by the Board for re-<\/p>\n<p>arranging another work which was originally entrusted to<\/p>\n<p>the petitioner but which was subsequently cancelled at his<\/p>\n<p>own risk and cost.     What is involved        is a claim and<\/p>\n<p>counter claim by the parties to a contract.          In these<\/p>\n<p>circumstances, remedy of the petitioner is before the Civil<\/p>\n<p>Court.
