Rule.\n<\/p>\n<p>With the consent of the parties, writ<br \/>\npetition is taken up for disposal  <\/p>\n<p>2. By this common order, I would be disposing of above mentioned two writ petitions as both<br \/>\nthe writ petitions raise common question regarding the<br \/>\nreservation of contract for security services in favor<br \/>\nof ex-servicemen and requirement for registration with<br \/>\nDirector General of Resettlement.\n<\/p>\n<p>3. By these writ petitions, petitioners<br \/>\nseek directions to Government of NCT of Delhi and N.C,T.D. not to violate the fundamental rights of the<br \/>\npetitioner firm for equality and freedom of trade and<br \/>\nbusiness as being enshrined and guaranteed under<br \/>\nArticle 14,16, 19 and 21 of the Constitution of India.<br \/>\nPetitioners also seek directions to N.C.T.D. for<br \/>\nissuance of the tender document and for allowing the<br \/>\npetitioners to participate inf the tenders.\n<\/p>\n<p>4. Counsel for the petitioners submits that<br \/>\nthe petitioners do not question the welfare measure as<br \/>\nwell as the object and the aim in introducing the<br \/>\nprovision of security services being manned by ex<br \/>\nservicemen. He himself states that such a measure is<br \/>\ndesigned for the welfare of ex serviceman and would not<br \/>\nviolate Article 14 or 19(1)(g) of the<br \/>\nconstitution of India. The petitioners&#8217; grievance<br \/>\nemanates out of the manner in which this is sought to<br \/>\nbe implemented. as per the counsel, terms and<br \/>\nconditions of the contract require that the security<br \/>\nservices agencies have to be either proprietorship or a<br \/>\nPrivate Ltd. Company run by ex-servicemen. Further a<br \/>\ncondition is stipulated that 90% of the employees<br \/>\nshould be ex-servicemen.\n<\/p>\n<p>5. Counsel for the petitioner submits that this<br \/>\ncondition is not being implemented and followed. He<br \/>\nseeks quashing of letter dated 21.7.1999, bearing<br \/>\nNo. F.O\/E in CPWD\/3049 and office memorandum F.O\/E in<br \/>\nCPWD\/3049 by respondents for issuance of<br \/>\nsecurity\/sanitation work tenders to only those security<br \/>\nagencies registered with Director General of<br \/>\nResettlement as arbitrary, illegal and<br \/>\nunconstitutional. He submits that he would give to the<br \/>\nrespondent&#8217;s counsel a list of contracts, where the<br \/>\nsecurity agencies are neither owned by ex-servicemen<br \/>\nnor 90% of ex serviceman are employed. Counsel for<br \/>\nrespondents 2 to 4 submits that in case any such list<br \/>\nwith full particulars is received, they would make<br \/>\nenquiries and act in accordance with law.\n<\/p>\n<p>6. Let the list of any such contravention be<br \/>\nsupplied by counsel for the petitioner within 4 weeks.<br \/>\nCounsel at this stage submits that condition regarding<br \/>\nsecurity agencies being owned by ex-servicemen officers<br \/>\nwho are either individual proprietors or Directors of<br \/>\nprivate limited companies, should not be there. It<br \/>\nshould be open for any individual to run the security<br \/>\nagencies only be engaging ex-servicemen. This would<br \/>\nreally tantamount to submitting that the ex-servicemen<br \/>\nofficers should not be rehabilitated and the<br \/>\nreservation should be confined only to ex-serviceman<br \/>\nemployees. The reservation made is two-fold. One is<br \/>\nfor ex-serviceman as officers, who are<br \/>\nproprietors\/owners to manage the agency, secondly the<br \/>\nagency must employ 90% ex-servicemen. There is no<br \/>\nrationale or basis to quash the reservation in respect<br \/>\nof officers. This Challenge has to fail.\n<\/p>\n<p>7.
