Justice ANTONY DOMINIC\n\n Dated :23\/03\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                    ================\n                 W.P.(C) NO. 9154 OF 2009 (L)\n                =====================\n\n            Dated this the 23rd day of March, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioner&#8217;s grievance is against Ext.P2, a tender notice<\/p>\n<p>published by the respondents inviting tenders for collection of<\/p>\n<p>toll at the Kumbalam-Aroor Bridge.\n<\/p>\n<p>      2.    Two contentions are raised. First was that the<\/p>\n<p>publication of Ext.P2 notification was inadequate and according<\/p>\n<p>to the petitioner, the notice was published only in Madhyamam<\/p>\n<p>Daily.\n<\/p>\n<p>      3.    The learned Government Pleader on instruction<\/p>\n<p>submits that in addition to Madhyamam Daily, tender notice was<\/p>\n<p>published in Kerala Koumudhi Daily and New Indian Express<\/p>\n<p>Daily. This, therefore shows that the submission made by the<\/p>\n<p>petitioner is factually incorrect.\n<\/p>\n<p>      4.    Then, it was contended that the condition for<\/p>\n<p>prequalification specified in Ext.P2 was arbitrary. Counsel<\/p>\n<p>submits that the experience prescribed in Ext.P2 was that the<\/p>\n<p>prospective tenderer should have undertaken a similar work, the<\/p>\n<p>value of which is Rs.66,43,400\/- in any one year within the<\/p>\n<p>WPC 9154\/09<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>immediately preceding 7 years.\n<\/p>\n<p>     5.   In my view, there is absolutely nothing wrong in the<\/p>\n<p>above prescription of experience. When a tender is invited, it is<\/p>\n<p>up to the awarding authority to decide what are the<\/p>\n<p>prequalification conditions to be incorporated in the tender<\/p>\n<p>notice and unless there is anything malafide or arbitrary, this<\/p>\n<p>Court will not be justified in interfering with such tender<\/p>\n<p>conditions.   Petitioner has not made out any such grounds<\/p>\n<p>warranting interference with Ext.P2. Further, a tender condition<\/p>\n<p>such as this, is intended to have response from experienced and<\/p>\n<p>capable tenderers.
