AND ANOTHER\n \n\nVersus\n \n\nUNION\nOF INDIA AND OTHERS\n \n\n======================================\nAppearance : \nMR\nPARESH M DAVE for the Petitioners \nMR HARIN P RAVAL for the\nRespondents \n====================================== \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE D.A.MEHTA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/07\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE D.A.MEHTA)<\/p>\n<p>1.\tThis<br \/>\npetition challenges order dated 19.7.2007 made by Commissioner<br \/>\n(Appeals), whereby the appeal of the petitioner was dismissed for not<br \/>\ncomplying with order dated 19.6.2007 directing the petitioner to<br \/>\ndeposit a sum of Rs.14,54,742\/- plus Rs.50,000\/- towards penalty for<br \/>\nthe Director, which was to be deposited by 16.7.2007.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner carried the matter in appeal before Tribunal who also<br \/>\nconfirmed the order of Commissioner (Appeals) after extending the<br \/>\ntime for making the deposit as directed by Commissioner (Appeals).<br \/>\nThe said order was made on 28.11.2007 granting 8 weeks to the<br \/>\npetitioner to deposit the amount as directed by Commissioner<br \/>\n(Appeals). The petitioner thereafter moved the Tribunal seeking<br \/>\nmodification of stay order on the basis of financial hardship being<br \/>\nfaced by the petitioner. The application was rejected vide order<br \/>\ndated 15th February, 2008 by the Tribunal. It is at this<br \/>\nstage that the petitioner approached the High Court.\n<\/p>\n<p>3.\tOn<br \/>\n1.7.2008, the following order came to be made by the Court.\n<\/p>\n<p>1.\t\u00fdSNOTICE<br \/>\nfor final disposal returnable on 04.07.2008.\n<\/p>\n<p>2.\tMr.Paresh<br \/>\nDave, learned counsel for the petitioner Company, states that<br \/>\nundertaking indicating the schedule of payment shall be submitted on<br \/>\nthe returnable date.\n<\/p>\n<p>3.\tMr.Harin<br \/>\nRaval, learned Assistant Solicitor General, waives service of notice<br \/>\nfor respondent No.1. Direct srevice is permitted on the rest.\u00fd\u00fd<\/p>\n<p>4.\tOn<br \/>\n22.7.2008, the learned advocate for the petitioner prayed for further<br \/>\ntime to place on record the indicative schedule of payment along with<br \/>\nundertaking in compliance with the earlier order dated 1.7.2008. The<br \/>\nschedule proposed by the petitioner is as under:\n<\/p>\n<p> SCHEDULE<br \/>\nOF PAYMENT\/DEPOSIT<\/p>\n<p>Sr.\n<\/p>\n<p>\t\t\t\tNo.\n<\/p>\n<p>Amount<br \/>\n\t\t\t\tto be deposited<\/p>\n<p>(Rs.)<\/p>\n<p>Date<br \/>\n\t\t\t\tof depositing<\/p>\n<p><span class=\"hidden_text\">1<\/span><\/p>\n<p>Rs.2,60,000\/-\n<\/p>\n<p>On<br \/>\n\t\t\t\tor before 20th August, 2008<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>Rs.2,60,000\/-\n<\/p>\n<p>On<br \/>\n\t\t\t\tor before 20th September, 2008<\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p>Rs.2,60,000\/-\n<\/p>\n<p>On<br \/>\n\t\t\t\tor before 20th October, 2008<\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p>Rs.2,60,000\/-\n<\/p>\n<p>On<br \/>\n\t\t\t\tor before 20th November, 2008<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>Rs.2,64,742\/-\n<\/p>\n<p>On<br \/>\n\t\t\t\tor before 20th December, 2008<\/p>\n<p>5.\tHeard<br \/>\nthe learned counsel appearing for the parties.\n<\/p>\n<p>6.\tIn<br \/>\nlight of the undertaking dated 28th July, 2008, the<br \/>\npetitioner is directed to abide by the aforestated schedule and<br \/>\ndeposit the amount as undertaken by the petitioner. It will be open<br \/>\nto the petitioner to complete the total amount of deposit even prior<br \/>\nto 31st December, 2008 so as to ensure that the petitioner<br \/>\nis saddled with minimum interest liability.\n<\/p>\n<p>7.\tUpon<br \/>\nthe petitioner depositing the amount as directed by Commissioner<br \/>\n(Appeals), the order dated 19.7.2007 made by Commissioner (Appeals)<br \/>\ndismissing the appeal shall stand quashed and set aside and the<br \/>\nappeal restored to file of Commissioner (Appeals) to be decided on<br \/>\nmerits. However, before such restoration takes place, the petitioner<br \/>\nshall obtain necessary certificate of having discharged the liability<br \/>\nof the entire amount as per order dated 19.6.2007 obtained from the<br \/>\nRange Superintendent and on production of the same before the office<br \/>\nof Commissioner (Appeals), the appeal shall stand restored to file.<br \/>\nNeedless to state that granting of installments as per aforesaid<br \/>\nschedule will not absolve the petitioner from liability to pay<br \/>\ninterest in accordance with law.\n<\/p>\n<p>8.\tSubject<br \/>\nto what is stated hereinbefore, the petition stands disposed of<br \/>\naccordingly.
