    Petitioners the accused in C.C.91\/1994 on<\/p>\n
the file of Chief Judicial Magistrate’s Court,<\/p>\n
Manjeri were convicted and sentenced for the<\/p>\n
offences under sections 205, 193, 465 and 468<\/p>\n
of Indian Penal Code.   The second accused was<\/p>\n
convicted additionally for the offence under<\/p>\n
section 471 of Indian Penal Code also.   Though<\/p>\n
petitioners  challenged   the  conviction  and<\/p>\n
sentence  before     Sessions  Court,   Manjeri<\/p>\n
learned Sessions Judge on reappreciation of<\/p>\n
evidence confirmed the conviction and sentence<\/p>\n
and dismissed the appeal.  First accused filed<\/p>\n
Crl.R.P.561\/2004    and      second     accused<\/p>\n
Crl.R.P.2503\/2003 challenging   the  conviction<\/p>\n
and sentence.\n<\/p>\n
Crl.R.P.561\/2004 & 2503\/2003       2\n\n      2.          Learned      counsel  appearing  for   the\n\npetitioners         and     learned  Public Prosecutor were\n\nheard.\n\n      3.         The    argument   of  the  learned  counsel\n\n<\/pre>\n
appearing for the petitioner in Crl.R.P.561\/2004 is<\/p>\n
that petitioner affixed his signature in Ext.P2<\/p>\n
compounding petition only on the threat of the<\/p>\n
petitioner         in    Crl.R.P.2503\/2003  and  as  he  was<\/p>\n
threatened he appeared before the Magistrate as<\/p>\n
Mohammed Salim, the complainant in C.C.53\/1994 and<\/p>\n
in     such      circumstances      the  conviction  is  not<\/p>\n
sustainable.           Learned counsel argued that in any<\/p>\n
case leniency may be shown in the sentence as he is<\/p>\n
an autorikshaw driver and it was only due to the<\/p>\n
compulsion he committed the offences.                Learned<\/p>\n
counsel          appearing      for    the   petitioner  in<\/p>\n
Crl.R.P.2503\/2003 argued that there is no evidence<\/p>\n
to prove that the signature of the complainant in<\/p>\n
C.C.53\/1994 is forged, as            Mohammad Salim,  though<\/p>\n
cited as CW1 was not examined.            It was argued that<\/p>\n
except the sworn statement of the first accused,<\/p>\n
Crl.R.P.561\/2004 & 2503\/2003       3<\/p>\n
there is no material to prove that the signature in<\/p>\n
the     compounding         petition  is not   that  of  the<\/p>\n
complainant          Mohammed    Salim  and  therefore   the<\/p>\n
conviction is not sustainable.\n<\/p>\n
      4.       Petitioner in Crl.R.P.2503\/2003 was the<\/p>\n
sole      accused       in   C.C.53\/1994  before  the  Chief<\/p>\n
Judicial Magistrate.            It was a case charge sheeted<\/p>\n
by the Sub Inspector of Police, Malappuram on the<\/p>\n
allegation         that     petitioner in  Crl.R.P.2503\/2003<\/p>\n
committed the offences under sections 341, 323, 337<\/p>\n
and 338 of Indian Penal Code.                 The de facto<\/p>\n
complainant         in     that  case  was  Mohammed  Salim.<\/p>\n
Learned counsel submitted that he was only one of<\/p>\n
the injured.           Whatever it be,    Ext.P2 compounding<\/p>\n
petition dated 30.9.1994 shows that when the case<\/p>\n
was called, petitioner produced Ext.P2 before the<\/p>\n
learned Magistrate as a compounding petition signed<\/p>\n
by him along with the injured Mohammed Salim.           The<\/p>\n
evidence        of    PW1    the  Bench  Clerk  with  Ext.P2<\/p>\n
establish that when the learned Magistrate got<\/p>\n
suspicious, while recording the sworn statement of<\/p>\n
Crl.R.P.561\/2004 & 2503\/2003       4<\/p>\n
the petitioner in Crl.R.P.561\/2004 who appeared as<\/p>\n
the complainant in C.C.53\/1994 Mohammed Salim, it<\/p>\n
was verified with PW2, Assistant Public Prosecutor<\/p>\n
and      thereafter         a  detailed  statement  of   the<\/p>\n
petitioner          in     Crl.R.P.561\/2004  was   recorded.<\/p>\n
Ext.P2 shows that the said petitioner disclosed to<\/p>\n
the learned Magistrate that he is              not Mohammed<\/p>\n
Salim but he signed in Ext.P2 as Mohammed Salim and<\/p>\n
it    was     at    the     instance of  the  petitioner  in<\/p>\n
Crl.R.P.2503\/2003 he signed in Ext.P2 as Mohammad<\/p>\n
Salim and he was threatened                by the revision<\/p>\n
petitioner in Crl.R.P.2503\/2003, to appear before<\/p>\n
the learned Magistrate as the complainant Mohammad<\/p>\n
Salim and due to the threat           he impersonated before<\/p>\n
the Magistrate as Mohammad Salim.            Though learned<\/p>\n
counsel          appearing      for    the  petitioner   in<\/p>\n
Crl.R.P.2503\/2003 argued that there is no evidence<\/p>\n
to prove that signature of Mohammad Salim seen in<\/p>\n
Ext.P2 is not that of Mohammad Salim but a forged<\/p>\n
signature            put      by     the   petitioner    in<\/p>\n
Crl.R.P.561\/2004,            as   Mohammad Salim   was  not<\/p>\n
Crl.R.P.561\/2004 & 2503\/2003     5<\/p>\n
examined though cited as witness, on the facts and<\/p>\n
evidence         I      cannot  agree.     Petitioner   in<\/p>\n
Crl.R.P.561\/2004            was examined by   the  learned<\/p>\n
Magistrate when Ext.P2 was presented before him and<\/p>\n
that sworn statement unambiguously and conclusively<\/p>\n
establish that the signature seen in Ext.P2 as that<\/p>\n
of Mohammed Salim was put by the petitioner in<\/p>\n
Crl.R.P.561\/2004.            I find the non-examination of<\/p>\n
Mohammad Salim is immaterial as far as the case is<\/p>\n
concerned.           Learned Magistrate and the learned<\/p>\n
Sessions Judge appreciated the evidence in the<\/p>\n
proper perspective and found that petitioner in<\/p>\n
Crl.R.P.561\/2004 impersonated himself          as Mohammad<\/p>\n
Salim and        signed as Mohammad Salim in Ext.P2.   The<\/p>\n
evidence also establish that it was the petitioner<\/p>\n
in Crl.R.P.2503\/2003 who made the petitioner in<\/p>\n
Crl.R.P.561\/2004, to sign as Mohammad Salim and<\/p>\n
also to appear before the learned Magistrate as<\/p>\n
Mohammad Salim by impersonation and it is the<\/p>\n
petitioner in Crl.R.P.2503\/2003 who made use of<\/p>\n
Ext.P2 which is proved to be a forged document as<\/p>\n
Crl.R.P.561\/2004 & 2503\/2003      6<\/p>\n
genuine in the judicial proceedings.                In such<\/p>\n
circumstances,           conviction  of  the  petitioner in<\/p>\n
Crl.R.P.561\/2004,           the    first  accused,  for  the<\/p>\n
offence under sections 205, 193, 465 and 468 of<\/p>\n
Indian Penal Code is perfectly legal and correct.<\/p>\n
So     also          conviction    of   the  petitioner  in<\/p>\n
Crl.R.P.2503\/2003           the   second  accused  for  the<\/p>\n
offences under sections 205, 193, 465, 468 and 471<\/p>\n
of Indian Penal Code is also perfectly legal and<\/p>\n
correct.\n<\/p>\n
      Then       the     only  question  is  regarding   the<\/p>\n
sentence.        As rightly found by the learned Sessions<\/p>\n
Judge,       the      sentence   awarded   by  the   learned<\/p>\n
Magistrate         cannot     be  said   to  be   excessive.<\/p>\n
Petitioners          had    forged  the  signature  of   the<\/p>\n
complainant and impersonated and attempted to make<\/p>\n
the Magistrate act upon the forged document as a<\/p>\n
compounding petition to close the case.             It is a<\/p>\n
very      serious matter effecting        the administration<\/p>\n
of criminal justice and warrants severe sentence.<\/p>\n
\n\nHence I find              no reason to interfere with the\n\nCrl.R.P.561\/2004 & 2503\/2003     7\n\nsentence also.\n\n      Revisions         are  dismissed.    Chief  Judicial\n\n<\/pre>\n
Magistrate, Manjeri is directed to execute the<\/p>\n
sentence.           Petitioners   are  directed to   appear<\/p>\n
before the Chief Judicial Magistrate, Manjeri on<\/p>\n
