The applicant-orig.accused has been convicted in Sessions<br \/>\nCase No. 104 of 2009  by the learned Addl.Sessions Judge, Mehsana,<br \/>\nfor the offences under Sections 363, 366, and 377 of IP Code, vide<br \/>\njudgment and order dated 17.6.2010.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Ms.Subhadraben Patel appearing for the applicant<br \/>\norig.accused submitted that the applicant was on bail during pendency<br \/>\nof the trial and also referred to the facts and with regard to the<br \/>\nevidence stating that the victim had accompanied the accused and<br \/>\nconsidering these facts, she has fair chances of success in the<br \/>\nappeal and therefore, the applicant may be released on bail.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr.Pujari resisted the application and submitted that the victim<br \/>\nwas minor and therefore, considering the provisions of Sec.376 of IP<br \/>\nCode as well as Sec.389 of the Code of Criminal Procedure, when prima<br \/>\nfacie the commission of offence is established and the applicant has<br \/>\nbeen convicted and therefore, the present application may not be<br \/>\nentertained.\n<\/p>\n<p>5.\tIn<br \/>\nview of the rival contentions, it is now required to be considered is<br \/>\nas to whether the present application may be entertained or not.<br \/>\nThough, normally,  in such circumstances when the conviction is<br \/>\nrecorded under Sec.376 of IP Code, the Court would be slow  in<br \/>\nexercising the discretion under Sec.389 of the Code of Criminal<br \/>\nProcedure. However, having regard to the facts and the manner in<br \/>\nwhich the offence has been committed and also considering the<br \/>\nmaterial evidence on record, the present application deserves to be<br \/>\nallowed.  Therefore, the present application is allowed.\n<\/p>\n<p>6.\tThe<br \/>\napplicant-orig.accused is ordered to be released on bail on his<br \/>\nexecuting a personal bond of Rs.10,000\/- (Rupees Ten thousand only)<br \/>\nwith a surety of like amount to the satisfaction of the lower Court<br \/>\nand subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigation officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before Udhna police Station on every 1st day<br \/>\nof Calendar month between 11.00 a.m. and 2.00 p.m.<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\nis made absolute.
