PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/05\/2011  \n \nORAL ORDER<\/pre>\n<p>\tLeave<br \/>\nto amend the name of the Police Station.\n<\/p>\n<p>\tRule.\n<\/p>\n<p>Learned APP, Mr Kodekar, waives service of notice of rule for and on<br \/>\nbehalf of State.\n<\/p>\n<p>2.\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nGujarat University Police Station, Ahmedabad vide C.R.No.I-300 of<br \/>\n2009  for the offences punishable under Section 379 of IPC.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr Gohil for the accused-applicant and Mr Kodekar,<br \/>\nlearned APP for the State. Perused the FIR. The parties does not<br \/>\npress for a reasoned order.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe role ascribed to the accused-applicant and the nature of<br \/>\nallegations levelled against the accused-applicant in the FIR, I am<br \/>\npersuaded to exercise my  discretion in favour of the<br \/>\naccused-applicant taking into consideration the following aspects :-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>The offences are Magistrate triable offence;\n<\/p>\n<p>(2)\tInvestigation<br \/>\nis over and chargesheet is filed;\n<\/p>\n<p>(3)\tThe<br \/>\ninterest of the prosecution can be protected by imposing certain<br \/>\nstringent terms and conditions against the accused-applicant.\n<\/p>\n<p>5.\tHaving<br \/>\nregard to the facts and circumstances of the case, the applicant is<br \/>\nordered<br \/>\nto be released on bail in connection C.R. No.I-300 of 2009 registered<br \/>\nwith Gujarat University Police Station, Ahmedabad  on his executing a<br \/>\nbond in the sum of Rs.25,000\/- (Rupees twenty five thousand only)<br \/>\nwith one solvent surety of the like amount to the satisfaction of the<br \/>\nlower Court and subject to the conditions that he shall,<\/p>\n<p>not<br \/>\n\tindulge in any such activity again;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence at Gujarat University Police Station, Ahmedabad on<br \/>\n\tevery alternate day  between 10:00 am to 2:00 pm till conclusion of<br \/>\n\tthe trial;\n<\/p>\n<p>not<br \/>\n\tleave the local limits of the city of Ahmedabad till conclusion of<br \/>\n\tthe trial;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>7.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>8.\tRule<br \/>\nis made absolute.
