Singh\nRespondent Counsel :- C.S.C.\n\nHon'ble Sanjay Misra,J.\n<\/pre>\n<p>Heard Sri A.P.Singh, learned counsel for the petitioner and learned<br \/>\nStanding Counsel for the respondents.\n<\/p>\n<p>By means of this writ petition, the petitioner has challenged the<br \/>\norder dated 8.5.1991 contained in Annexure-2 to the writ petition<br \/>\nas also the orders passed by the Board of Revenue. The petitioner<br \/>\nhas also claimed to issue a writ of mandamus commanding the<br \/>\nBoard of Revenue, U.P. Lucknow to consider the petitioner for<br \/>\npromotion to the post of Naib Tehsildar and permit him to<br \/>\ncontinue on the said post.\n<\/p>\n<p>According to learned counsel for the petitioner, the petitioner was<br \/>\nengaged as a Seasonal Collection Amin and was subsequently<br \/>\nconfirmed thereupon. He was given charge to work as Naib<br \/>\nTehsildar under the U.P. Subordinate Revenue Executive (Naib<br \/>\nTehsildar) Rules, 1944 from time to time and ultimately he<br \/>\nclaimed promotion. When the charge from the post of Naib<br \/>\nTehsildar was taken and he was relieved by the impugned order<br \/>\ndated 8.5.1991, he assailed the same by means of this writ petition<br \/>\nand an interim order dated 30.5.1991 was passed in his favour,<br \/>\nwhich is still operative. Under the interim order, it was provided<br \/>\nthat in case the petitioner is working as Naib Tehsildar and juniors<br \/>\nto the petitioner are permitted to continue, the petitioner shall also<br \/>\nbe allowed to work as Naib Tehsildar and will not be reverted.\n<\/p>\n<p>In the counter affidavit, it has been stated that the petitioner was<br \/>\nconfirmed as a Collection Amin on 31.2.1991 and according to<br \/>\nparagraph 13, the Board of Revenue is regularizing only those<br \/>\npersons, who are working as Naib Tehsildar on adhoc basis prior<br \/>\nto 1.1.1985. The case of the respondent is that on 1.1.1985, the<br \/>\npetitioner was not working on adhoc basis as Naib Tehsildar and<br \/>\ntherefore, his claim for promotion on that basis cannot be granted.\n<\/p>\n<p>Sri A.P.Singh, learned counsel for the petitioner has submitted that<br \/>\nunder the Uttar Pradesh Regularisation of Adhoc Promotion (On<br \/>\n Posts Outside the Purview of the Public Service Commission)<br \/>\nRules,1988, the cut of date 1.1.1985 was the date for<br \/>\npromotion\/confirmation and such date has now been extended to<br \/>\nbe 30.6.1998. Admittedly according to the petitioner, he was<br \/>\nworking on the post of Naib Tehsildar on adhoc basis on the<br \/>\nstrength of the interim order dated 30.5.1991 and as such<br \/>\naccording to him he is entitled to be considered for promotion<br \/>\nunder 1988 Rules<\/p>\n<p>In paragraphs 13 of the counter affidavit, it has been stated that the<br \/>\npetitioner having worked on adhoc basis since 1991, he would not<br \/>\nbe entitled to be considered for regularization on the promoted<br \/>\npost of Naib Tehsildar since the cut of date was 1.1.1985.\n<\/p>\n<p>In view of the aforesaid case taken by the petitioner and also by<br \/>\nthe States respondent, insofar as the first relief is concerned, no<br \/>\nerror can be found in the impugned order. However, since the<br \/>\npetitioner has been working by virtue of the interim order dated<br \/>\n30.5.1991, he would be entitled for being considered for<br \/>\npromotion\/regularization on the post of Naib Tehsildar in<br \/>\naccordance with 1988 Rules where the cut of date is 30.6.1998.\n<\/p>\n<p>In view of the aforesaid circumstances, this writ petition stands<br \/>\ndisposed of with a direction to the respondent no.2, Secretary,<br \/>\nBoard of Revenue, U.P. Lucknow to consider the case of the<br \/>\npetitioner in accordance with law.\n<\/p>\n<p>It is made clear that this Court has not expressed its opinion on the<br \/>\nmerit of the claim for promotion\/regularization made by the<br \/>\npetitioner in this writ petition and that has to be done by the<br \/>\nrespondent no.2.\n<\/p>\n<p>No order is passed as to costs.\n<\/p>\n<p>Order Date :- 27.1.2010<br \/>\nLbm\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Tej Pratap Singh vs State Of U.P.
