The main accused is relesed on bail. Considering the role played by the present applicant-accused,this application deserves to be allowed.\n<\/p>\n<p>5.\t  Accordingly, the application is allowed. The applicant is ordered to be realeased on bail in connection with CR no.I-73\/2008 registered with Kapadvanj Town Police Station , for the offences alleged against him in this petition on his executing a personal bond of Rs.10,000\/-(Rupees ten thousand) with one surety of the like amount to the satisfaction of the lower Court and subjection to the condition that he shall:-\n<\/p>\n<p>\t(a) \tnot  take  undue advantage of his  liberty   or \tmisuse \t\this \tliberty;\n<\/p>\n<p> \t(b)\tnot to act in a manner injurious  to  the<br \/>\n                   interest of the prosecution;\n<\/p>\n<p>         \t(c) \tmaintain law and order;\n<\/p>\n<p>        \t(d) \tnot leave the   State of Gujarat  without  the   prior<br \/>\n              \tpermission   of  the Sessions  Judge concerned.\n<\/p>\n<p>      \t(e)\tfurnish  the  address of his  residence to the I.O and \t\talso to  the Court at the time of execution  of  the  bond \t\tand shall not change his residence without prior \t\t\tpermission of this Court;\n<\/p>\n<p>       \t(f)\tsurrender his passport, if any,to the lower Court within \t\ta week;\n<\/p>\n<p>\t(g)\tmark his presence at the concerned Police Station on \t\tthe first of every English Calendar month between 9.00 \t\ta.m. and 2.00 p.m. till the trial is over.\n<\/p>\n<p>\t(h)\tnot enter into the limits of Kheda District, except for the \t\tpurpose of attending Court proceedings and marking \t\tpresence at the concerned Police Station, for six \t\t\tmonths.\n<\/p>\n<p>6.\tIf breach of any of the above  condition   is  committed,  the Sessions Judge concerned will be free to  issue  warrant  or  take  appropriate action in the matter.\n<\/p>\n<p>7.    \tBail before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>8.\tRule is made absolute.
